SYNOPSIS AS INTRODUCED:

10 ILCS 5/1A-13

from Ch. 46, par. 1A-13

Amends the Election Code. Provides that no member of the State Board
of Elections or affiliated person shall contribute, either financially or
in services or goods or any other way, to any political party, candidate,
or organization engaged in political activity. Defines terms. Effective
immediately.

AN ACT concerning elections.

Be it enacted by the People of the State of Illinois,

represented in the General Assembly:

Section 5.
The Election Code is amended by changing
5
Section 1A-13 as follows:

(10 ILCS 5/1A-13)

Sec. 1A-13.
Prohibited political activities.

8

(a)
No employee of the State Board of Elections
,
including
9
its executive director and assistant executive director
,
shall
10
engage in any partisan political activity whatsoever, except
11
to vote at elections, nor shall such person contribute, either
12
financially or in services or goods or any other way, to any
13
political party, candidate
,
or organization engaged in
14
political activity. No employee of the Board shall become a
15
candidate for nomination for, or election to, or accept
16
appointment to any public office. Whoever violates any
17
provision of this Section shall be deemed to have vacated his
18
position and shall be discharged. No such person shall be
19
thereafter rehired unless the State Civil Service Commission,
20
upon appeal, finds that this Section has not been violated by
21
such person.

(b) No member of the State Board of Elections or an
23
affiliated person shall contribute, either financially or in

services or goods or any other way, to any political party,
2
candidate, or organization engaged in political activity.

As used in this subsection:
4

"Affiliated person" means:
5

(1) a spouse or household member;
6

(2) a person who shares a common financial interest
7

with the member through a partnership, joint venture, or
8

similar arrangement;

9

(3) an officer, director, or executive employee of a
10

business entity controlled by or established by the
11

member; or

12

(4) a person who holds an ownership interest,
13

beneficial interest, or distributive share greater than
14

7.5% in any business entity in which the member also holds
15

an ownership or beneficial interest.
16

"Business entity" means any entity doing business for
17
profit, whether organized as a corporation, partnership, sole
18
proprietorship, limited liability company or partnership, or
19
otherwise.

Section 99.
Effective date.
This Act takes effect upon

becoming law.
