SYNOPSIS AS INTRODUCED:

New Act

Creates the Racing Facility Protection Act. Provides that a person
licensed under the Illinois Horse Racing Act of 1975 or any person that
owns a motorsport racing facility that is authorized to conduct motorsport
racing by a recognized national authority or a unit of local government may
not be subject to a civil action brought by a surrounding property owner to
the racing facility or racetrack for allegations of nuisance, taking, or
other theory if the racing facility or racetrack was built before the
surrounding real property owner either purchased the real property or
built in the area of the racing facility or racetrack.

AN ACT concerning civil law.

Be it enacted by the People of the State of Illinois,

represented in the General Assembly:

Section 1.
Short title.
This Act may be cited as the
Racing
5
Facility Protection Act.

Section 5.
Definitions.
As used in this Act:

"Motorsport racing" means a competitive sport in which
8
motor vehicles or motorcycles are raced against each other to
9
achieve the fastest times or distances.

"Racing facility" or "racetrack" means a designated area
11
or facility where horse races or motorsport races are
12
conducted. "Racing facility" or "racetrack" includes the
13
track, spectator areas, horse stalls, garages, and any
14
associated grounds or buildings used to operate the races.

Section 10.
Liability.
No person licensed under the
16
Illinois Horse Racing Act of 1975 or any person that owns a
17
racing facility used for motorsport racing that is authorized
18
by a recognized national authority or a unit of local
19
government may be subject to a civil action brought by a
20
surrounding property owner to the racing facility or racetrack
21
for allegations of nuisance, taking, or other theory if the
22
racing facility or racetrack was built before the surrounding
