SYNOPSIS AS INTRODUCED:

50 ILCS 705/10.19

Amends the Illinois Police Training Act. Provides that the Illinois
Law Enforcement Training Standards Board shall conduct or approve a
required (rather than optional) advanced training program for law
enforcement officers to recognize and respond to anaphylaxis, including
the administration of an epinephrine auto-injector. Provides that a local
law enforcement agency shall authorize (rather than may authorize) a law
enforcement officer who has completed the required advanced training
regarding anaphylaxis and the administration of an epinephrine
auto-injector to carry, administer, or assist with the administration of
epinephrine auto-injectors provided by the local law enforcement agency
whenever the officer is performing official duties. Allows rulemaking by
the Illinois Law Enforcement Training Standards Board to implement the
amendatory Act.

AN ACT concerning government.

Be it enacted by the People of the State of Illinois,

represented in the General Assembly:

Section 5.
The Illinois Police Training Act is amended by
5
adding Section 10.19 as follows:

6

(50 ILCS 705/10.19)
7

Sec. 10.19.
Training; administration of epinephrine.
8

(a) This Section, along with Section 40 of the Illinois
9
State Police Act, may be referred to as the Annie LeGere Law.
10

(b) For purposes of this Section, "epinephrine
11
auto-injector" means a single-use device used for the
12
automatic injection of a pre-measured dose of epinephrine into
13
the human body prescribed in the name of a local law
14
enforcement agency.
15

(c) The Board shall conduct or approve
a required

an
16
optional
advanced training program for law enforcement
17
officers to recognize and respond to anaphylaxis, including
18
the administration of an epinephrine auto-injector. The
19
training must include, but is not limited to:
20

(1) how to recognize symptoms of an allergic reaction;
21

(2) how to respond to an emergency involving an
22

allergic reaction;
23

(3) how to administer an epinephrine auto-injector;

(4) how to respond to an individual with a known

allergy as well as an individual with a previously unknown
3

allergy;
4

(5) a test demonstrating competency of the knowledge
5

required to recognize anaphylaxis and administer an
6

epinephrine auto-injector; and
7

(6) other criteria as determined in rules adopted by
8

the Board.

(d) A local law enforcement agency
shall

law enforcement officer who has completed

carry, administer, or assist with the administration of
13
epinephrine auto-injectors provided by the local law
14
enforcement agency whenever the officer is performing official
15
duties.

(e)
Each

local law enforcement agency that authorizes
17
its officers to carry and administer epinephrine
18
auto-injectors under subsection (d) must establish a policy to
19
control the acquisition, storage, transportation,
20
administration, and disposal of epinephrine auto-injectors and
21
to provide continued training in the administration of
22
epinephrine auto-injectors.
23

(f) A physician, physician assistant with prescriptive
24
authority, or advanced practice registered nurse with
25
prescriptive authority may provide a standing protocol or
26
prescription for epinephrine auto-injectors in the name of a

local law enforcement agency to be maintained for use when
2
necessary.

(g) When a law enforcement officer administers an
4
epinephrine auto-injector in good faith, the law enforcement
5
officer and local law enforcement agency, and its employees
6
and agents, including a physician, physician assistant with
7
prescriptive authority, or advanced practice registered nurse
8
with prescriptive authority who provides a standing order or
9
prescription for an epinephrine auto-injector, incur no civil
10
or professional liability, except for willful and wanton
11
conduct, or as a result of any injury or death arising from the
12
use of an epinephrine auto-injector.

(h) The Board shall adopt rules to implement this Section,
14
including, but not limited to:

15

(1) minimum training standards;
16

(2) guidelines to control the acquisition, storage,
17

transportation, administration, and disposal of
18

epinephrine auto-injectors; and
19

(3) documentation and reporting requirements following
20

the administration of epinephrine by a law enforcement
21

officer.
