SYNOPSIS AS INTRODUCED:

20 ILCS 2310/2310-750 new

Amends the Department of Public Health Powers and Duties Law of the
Civil Administrative Code of Illinois. Requires the Department of Public
Health to issue a notification to public officials when a hospital,
medical facility, nursing home, rehabilitation center, or any other health
care facility licensed by the State fails any kind of federally required or
State-required inspection or fails to pay State taxes. Provides that the
Department shall publish a report quarterly, on a publicly accessible
website, of all hospitals, medical facilities, nursing homes,
rehabilitation centers, and any other health care facilities licensed by
the State that have failed any kind of federally required or
State-required inspection or failed to pay State taxes.

AN ACT concerning regulation.

Be it enacted by the People of the State of Illinois,

represented in the General Assembly:

Section 5.
The Department of Public Health Powers and
5
Duties Law of the Civil Administrative Code of Illinois is
6
amended by adding Section 2310-750 as follows:

(20 ILCS 2310/2310-750 new)
8

Sec. 2310-750.
Notification and report for failed
9
inspections and tax delinquency.

(a) The Department shall issue a notification when a
11
hospital, medical facility, nursing home, rehabilitation
12
center, or any other health care facility licensed by the
13
State fails any kind of federally required or State-required
14
inspection or fails to pay State taxes.
15

(b) The notification shall be sent via email or mail to
16
public officials, including:
17

(1) the mayor or village president of the municipality
18

in which the facility resides;
19

(2) the State senator of the district in which the
20

facility resides;
21

(3) the State representative of the district in which
22

the facility resides; and
23

(4) the administrative office of the facility.

(c) The Department shall publish a report quarterly, on a
2
publicly accessible website, of all hospitals, medical
3
facilities, nursing homes, rehabilitation centers, and any
4
other health care facilities licensed by the State that have
5
failed any kind of federally required or State-required
6
inspection or failed to pay State taxes, including, but not
7
limited to, the type of inspection failed, the amount of any
8
State taxes that remain unpaid at the end of the quarter, and
9
any steps the facility has taken or will take to remedy the
10
failure.
