SYNOPSIS AS INTRODUCED:

110 ILCS 330/11 new
210 ILCS 85/6.35 new

Amends the Hospital Licensing Act. Prior to discharge of a postpartum
patient, requires a hospital to ensure that a postpartum follow-up
appointment is scheduled with an appropriate obstetric care provider.
Provides that the appointment shall be scheduled for a date consistent
with clinical guidelines, but no later than 6 weeks following birth,
unless an earlier visit is medically indicated. Provides that a registered
nurse or other designated clinical staff member may fulfill the scheduling
requirement. Provides that a patient may decline to have an appointment
scheduled, and such declination shall be documented in the patient's
medical record. Establishes specified exemptions from discipline if an
attempt to schedule an appointment was made. Grants the Department of
Public Health rulemaking authority. Amends the University of Illinois
Hospital Act to establish the same requirements for the University of
Illinois Hospital. Effective January 1, 2027.

AN ACT concerning regulation.

Be it enacted by the People of the State of Illinois,

represented in the General Assembly:

Section 5.
The University of Illinois Hospital Act is
5
amended by adding Section 11 as follows:

(110 ILCS 330/11 new)

Sec. 11.
Postpartum appointment scheduling required.
The
8
University of Illinois Hospital shall comply with Section 6.35
9
of the Hospital Licensing Act.

Section 10.
The Hospital Licensing Act is amended by
11
adding Section 6.35 as follows:

(210 ILCS 85/6.35 new)

Sec. 6.35.
Postpartum appointment scheduling required.
14

(a) In this Section:
15

"Postpartum patient" means an individual who has given
16
birth and is receiving inpatient post-delivery care.
17

"Postpartum follow-up appointment" means an appointment
18
with a licensed obstetrician-gynecologist, certified nurse
19
midwife, or other qualified obstetric provider.
20

(b) Prior to discharge of a postpartum patient, a hospital
21
shall ensure that a postpartum follow-up appointment is

scheduled with an appropriate obstetric care provider.

(c) The appointment shall be scheduled for a date
3
consistent with clinical guidelines, but no later than 6 weeks
4
following birth, unless an earlier visit is medically

indicated.

(d) A registered nurse or other designated clinical staff
7
member may fulfill the scheduling requirement.
8

(e) A patient may decline to have an appointment
9
scheduled, and such declination shall be documented in the
10
patient's medical record.

(f) A registered nurse or other designated clinical staff
12
may not be disciplined or penalized if a postpartum follow-up
13
appointment before the patient is 6 weeks postpartum is
14
unavailable as long as an attempt to schedule was made.
15

(g) The Department of Public Health may adopt rules
16
necessary to implement and enforce this Section.

Section 99.
Effective date.
This Act takes effect on
18
January 1, 2027.
