SYNOPSIS AS INTRODUCED:
405 ILCS 20/3d
from Ch. 91 1/2, par. 303d
Amends the Community Mental Health Act. Provides that the governing
body of a community mental health board may from time to time fix, by
ordinance, compensation for board members. Permits such compensation to be
computed on a per diem basis, on an annual basis, or on a combined per diem
and annual basis. Provides that until compensation is fixed by the
governing board, members of the community mental health board shall serve
without compensation. Provides that, after compensation is established, no
change in the compensation of any member, or the basis therefore, shall
take effect during the term of office for which such member has been
appointed. Provides that compensation for board members shall be charged
on the board and paid out of the Community Mental Health Fund. Prohibits a
board member's spouse or immediate family member from receiving any
compensation for the board member's service on the board.

AN ACT concerning mental health.

Be it enacted by the People of the State of Illinois,

represented in the General Assembly:

Section 5.
The Community Mental Health Act is amended by
5
changing Section 3d as follows:

Sec. 3d.
The expenses incurred by any community mental
8
health board in the performance of duties imposed upon it or
9
its members shall be a charge on the board and shall be paid
10
out of the "Community Mental Health Fund" hereinafter
11
established.

The governing body may from time to time fix, by
13
ordinance, compensation for members of the community mental
14
health board. Such compensation may be computed on a per diem
15
basis, on an annual basis, or on a combined per diem and annual
16
basis.

Until compensation is fixed by the governing body as
18
provided in this Section, members of the community mental
19
health board shall serve without compensation. Once fixed, no
20
change in the compensation of any member, or the basis
21
therefore, shall take effect during the term of office for
22
which such member has been appointed.

Any compensation provided for by the governing body under

this Section shall be a charge on the board and shall be paid
2
out of the "Community Mental Health Fund".

Notwithstanding any other provision of this Section, no
4
person who is the spouse of or an immediate family member
5
living with any member of the governing body may receive any
6
compensation whatsoever for his or her service on a community
7
mental health board.
No member shall receive payment, except
8
expenses, for service on the board.
