SYNOPSIS AS INTRODUCED:

30 ILCS 605/7.3

from Ch. 127, par. 133b10.3

Amends the State Property Control Act. Provides that the board of
trustees of a public university or college in Illinois that offers courses
in aviation, flight training, or other subjects involving knowledge of the
workings of an airplane may sell a qualified transferable airplane,
including its parts, to a bona fide purchaser for value and on terms that
are in the best interests of that public university or college and are
consistent with that university's or college's objects and purposes.
Provides that the public university or college may retain the proceeds
from the sale in a separate account for the purpose of maintaining the
university's or college's fleet of aircraft or for the purpose of
purchasing replacement aircraft.

Be it enacted by the People of the State of Illinois,

represented in the General Assembly:

Section 5.
The State Property Control Act is amended by
5
changing Section 7.3 as follows:

Sec. 7.3.
Administrator; transferable property.

(a) Except as otherwise provided in subsection (c), the

Administrator shall have charge of all transferable
10
property and shall have authority to take possession and
11
control of such property in order to transfer or assign any
12
such property to any other State agency that has need or use
13
for such property or to dispose of said property in accordance
14
with Section 7 of this Act.
15

(b)
The Administrator may not dispose of a transferable
16
airplane by sale until he or she determines that (i) the agency
17
no longer has a need for the airplane, (ii) the airplane will
18
not be used as a trade-in on another aircraft, and (iii) no
19
public university or college in Illinois that offers courses
20
in aviation, flight training, or other subjects involving
21
knowledge of the workings of an airplane has listed the need
22
for an airplane as provided in this Section.

(c) In addition to the powers granted to the Administrator

under this Section, the Board of Trustees of a public
2
university or college in Illinois that offers courses in
3
aviation, flight training, or other subjects involving
4
knowledge of the workings of an airplane may dispose of a
5
qualified transferable airplane, including its parts, by sale
6
to a bona fide purchaser for value and on such terms as the
7
Board shall determine are in the best interests of that public
8
university or college and are consistent with that
9
university's or college's objects and purposes. If the Board
10
of Trustees or the Administrator sells a qualified
11
transferable airplane or its parts, then the public university
12
or college may retain the proceeds from the sale in a separate
13
account for the purpose of maintaining the university's or
14
college's fleet of aircraft or for the purpose of purchasing
15
replacement aircraft. The Auditor General shall examine the
16
separate account to ensure that the use or deposit of the
17
proceeds authorized under this subsection (c) is in a manner
18
consistent with the purposes set forth in this subsection. As
19
used in this subsection, "qualified transferable airplane"
20
means a transferable airplane that is owned by a public
21
university or college in Illinois and that is used for
22
instruction in aviation, flight training, or other subjects
23
involving knowledge of the workings of an airplane.

(d)
Responsible officers shall periodically report all
25
transferable property at locations under their jurisdictions
26
to the Administrator. The Administrator shall review such

reports and arrange for physical examination of said property
2
if necessary to determine if said items of transferable
3
property should be transferred to another State agency,
4
transferred to a central warehouse, or disposed of. The
5
Administrator shall advise responsible officers of the results
6
of these reviews as necessary.

(e)
The staff under the jurisdiction of the Administrator
8
shall review as necessary State agencies' inventories for
9
potential items of transferable property. If in the opinion of
10
the Administrator's staff, any property appears to be
11
transferable, the Administrator shall notify the responsible
12
officer of his determination. The executive head of the agency
13
holding the property in question may appeal the determination
14
in writing to the Administrator.

(f)
The Administrator will review the determination in
16
accordance with rules and procedures established pursuant to
17
Section 5 of this Act.

(g)
The Administrator shall maintain lists of transferable
19
property and of State agency needs for such property and will
20
transfer where appropriate listed transferable property to
21
agencies listing their needs for such property as detailed by
22
their responsible officers. The Administrator must give
23
priority for transfer of an airplane, that is not to be used as
24
a trade-in, to a public university or college in Illinois that
25
offers courses in aviation, flight training, or other subjects
26
involving knowledge of the workings of an airplane and that

has listed the need for an airplane.
