SYNOPSIS AS INTRODUCED:

415 ILCS 5/22.23g new

Amends the Environmental Protection Act. Provides that, beginning
January 1, 2028, no person may knowingly cause or allow the mixing of a
photovoltaic module with municipal waste that is intended for disposal at
a landfill. Provides that, beginning January 1, 2028, no person may
knowingly cause or allow the disposal of a photovoltaic module in a
sanitary landfill. Defines "consumer electronic device" and "photovoltaic
module". Effective January 1, 2027.

AN ACT concerning safety.

Be it enacted by the People of the State of Illinois,

represented in the General Assembly:

Section 5.
The Environmental Protection Act is amended by
5
adding Section 22.23g as follows:

6

(415 ILCS 5/22.23g new)
7

Sec. 22.23g.
Photovoltaic modules.
8

(a) As used in this Section:
9

"Consumer electronic device" means any device containing
10
an electronic circuit board that is intended for everyday use
11
by individuals.

12

"Photovoltaic module" means the smallest, nondivisible,
13
environmentally protected assembly of photovoltaic cells or
14
other photovoltaic collector technology, and any ancillary
15
part, intended to generate electrical power under sunlight.
16
"Photovoltaic module" does not include a photovoltaic cell
17
that is part of a consumer electronic device for which it
18
provides electricity needed to make the consumer electronic
19
device function. "Photovoltaic module" includes, but is not
20
limited to, interconnections, terminals, and protective
21
devices, such as diodes, that are:

(1) installed on, connected to, or integral to
23

buildings;

(2) used as components of freestanding, off-grid power
2

generation systems, such as for powering water pumping
3

stations, electric vehicle charging stations, fencing,
4

street and signage lights, and other commercial or
5

agricultural purposes; or
6

(3) part of a system connected to a grid or utility
7

service.

(b) Beginning January 1, 2028, no person may knowingly
9
cause or allow the mixing of a photovoltaic module with
10
municipal waste that is intended for disposal at a landfill.
11

(c) Beginning January 1, 2028, no person may knowingly
12
cause or allow the disposal of a photovoltaic module in a
13
sanitary landfill.

Section 99.
Effective date.
This Act takes effect January
15
1, 2027.
