SYNOPSIS AS INTRODUCED:
225 ILCS 411/25-75
Amends the Cemetery Oversight Act. In provisions concerning the
Cemetery Relief Fund, provides that the Fund shall be used by the State
Comptroller (instead of the Department of Financial and Professional
Regulation) solely for the purpose of providing reimbursements (instead of
grants) to units of local government, to cemeteries registered with the
State Comptroller, and to not-for-profit organizations to clean up
cemeteries that have been abandoned or neglected, are at risk of going into
receivership, insolvency, or being abandoned, or are otherwise in need of
additional care. Provides that, in the event there is a structural surplus
in the Cemetery Oversight Licensing and Disciplinary Fund, the Department
may transfer (instead of expend) moneys out of the Cemetery Oversight
Licensing and Disciplinary Fund for the reimbursements.

AN ACT concerning regulation.

Be it enacted by the People of the State of Illinois,

represented in the General Assembly:

Section 5.
The Cemetery Oversight Act is amended by
5
changing Section 25-75 as follows:
6
(225 ILCS 411/25-75)
7
(Section scheduled to be repealed on January 1, 2027)
8
Sec. 25-75.
Cemetery Relief Fund.
9
(a) A special income-earning fund is hereby created in the
10
State treasury, known as the Cemetery Relief Fund.
11
(b) Beginning on July 1, 2011, and occurring on an annual
12
basis every year thereafter, three percent of the moneys in
13
the Cemetery Oversight Licensing and Disciplinary Fund shall
14
be transferred into the Cemetery Relief Fund.

(c) All
moneys
monies
transferred into the
Fund
fund
16
together with all accumulated undistributed income thereon
17
shall be held as a special fund in the State treasury. The
Fund
18
fund
shall be used
by the State Comptroller
solely for the
19
purpose of providing
reimbursements
grants
to units of local
20
government
, to cemeteries registered with the State
21
Comptroller,
and
to
not-for-profit organizations, including,

but not limited to, not-for-profit cemetery authorities, to

clean up cemeteries that have been abandoned
or

(d) The
grant
reimbursement
program shall be administered
4
by the
State Comptroller
Department
.

(e) In the event there is a structural surplus in the
6
Cemetery Oversight Licensing and Disciplinary Fund, the
7
Department may
transfer
expend
moneys out of the Cemetery
8
Oversight Licensing and Disciplinary Fund for the purposes
9
described in subsection (c) of this Section.
