SYNOPSIS AS INTRODUCED:

Amends the African-American HIV/AIDS Response Act. Provides that, on
August 1, 2026, and August 1 of each year thereafter, the Comptroller shall
order transferred and the Treasurer shall transfer from the General
Revenue Fund to the African-American HIV/AIDS Response Fund a sum equal to
the difference between (i) $15,000,000 and (ii) the amount appropriated to
the African-American HIV/AIDS Response Fund by the General Assembly for
the award of African-American HIV/AIDS Response Grants in the then current
State fiscal year. Directs the Department of Public Health to adopt
specified revisions to the rules in the African-American HIV/AIDS Response
Code (77 Ill. Adm. Code Part 691) concerning the award of African-American
HIV/AIDS Response Grants. Repeals provisions in the Act concerning
African-American HIV/AIDS Response Officers and the HIV/AIDS Response
Review Panel. Effective immediately.

AN ACT concerning health.

Be it enacted by the People of the State of Illinois,
3
represented in the General Assembly:

Section 5.
The African-American HIV/AIDS Response Act is
5
amended by changing Sections 27 and 30 as follows:
6

Sec. 27.
African-American HIV/AIDS Response Fund.
8
(a) The African-American HIV/AIDS Response Fund is created
9
as a special fund in the State treasury. Moneys deposited into
10
the Fund shall, subject to appropriation, be used for grants
11
for programs to prevent the transmission of HIV and other
12
programs and activities consistent with the purposes of this
13
Act, including, but not limited to, preventing and treating
14
HIV/AIDS, the creation of an HIV/AIDS service delivery system,
15
and the administration of the Act. The grants under this
16
Section may be administered by a lead agent selected by the
17
Department of Public Health, considering the entity's ability
18
to administer grants and familiarity with the grantees'
19
programs, and that selection shall be exempt from the public
20
notice of funding opportunity under the Grant Accountability
21
and Transparency Act or any rule regarding the public notice
22
of funding opportunity adopted under that Act. The lead agent
23
must demonstrate the ability to administer the grant to

subgrantees in compliance with the requirements of the Grant
2
Accountability and Transparency Act. Moneys for the Fund shall
3
come from appropriations by the General Assembly, federal
4
funds, and other public resources.
On August 1, 2026, and
5
August 1 of each year thereafter, the Comptroller shall order
6
transferred and the Treasurer shall transfer from the General
7
Revenue Fund to the African-American HIV/AIDS Response Fund a
8
sum equal to the difference between (i) $15,000,000 and (ii)
9
the amount appropriated to the African-American HIV/AIDS
10
Response Fund by the General Assembly for the award of
11
African-American HIV/AIDS Response Grants in the then current
12
State fiscal year.

(b) The Fund shall provide resources for communities in
14
Illinois to create an HIV/AIDS service delivery system that
15
reduces the disparity of HIV infection and AIDS cases between
16
African-Americans and other population groups in Illinois that
17
may be impacted by the disease by, including but, not limited
18
to:
19
(1) developing, implementing, and maintaining a
20
comprehensive, culturally sensitive HIV Prevention Plan
21
targeting communities that are identified as high-risk in
22
terms of the impact of the disease on African-Americans;
23
(2) developing, implementing, and maintaining a stable
24
HIV/AIDS service delivery infrastructure in Illinois
25
communities that will meet the needs of African-Americans;
26
(3) developing, implementing, and maintaining a

statewide HIV/AIDS testing program;
2
(4) providing funding for HIV/AIDS social and
3
scientific research to improve prevention and treatment;
4
(5) providing comprehensive technical
and operational
5
support
and other assistance to African-American community
6
service organizations that are involved in HIV/AIDS
7
prevention and treatment;
8
(6) developing, implementing, and maintaining an
9
infrastructure for African-American community service
10
organizations to make them less dependent on government
11
resources;
12
(7) (blank); and
13
(8) creating, maintaining, or creating and maintaining
14
at least one Black-led Center of Excellence HIV Biomedical
15
Resource Hub for every $3,000,000 of available funding to
16
improve Black health and eliminate Black HIV-related
17
health disparities; a Center of Excellence may be
18
developed on a stand-alone or a collaborative basis and
19
may provide regional comprehensive HIV preventative care
20
and essential support services, which may include, but are
21
not limited to, PrEP assessment, same day prescription
22
delivery, primary HIV medical care or referral, case
23
management, outpatient mental health, outpatient substance
24
abuse, treatment, medication adherence, nutritional
25
supplemental support, housing, financial assistance,
26
workforce development, criminal justice involvement, and

advocacy services.

(c) When providing grants pursuant to this Fund, the
3
Department of Public Health shall give priority to the
4
development of comprehensive medical and social services to
5
African-Americans at risk of infection from or infected with
6
HIV/AIDS in areas of the State determined to have the greatest
7
geographic prevalence of HIV/AIDS in the African-American
8
population.

Sec. 30.
Rules.
13
(a) No later than March 15, 2006, the Department of Public
14
Health shall issue proposed rules for designating high-risk
15
communities and for implementing subsection (c) of Section 15.
16
The rules must include, but may not be limited to, a standard
17
testing protocol, training for staff, community-based
18
organization experience, and the removal and proper disposal
19
of hazardous waste.
20
(b) The Department of Human Services, the Department of
21
Public Health, and the Department of Corrections shall adopt
22
rules as necessary to ensure that this Act is implemented
23
within 6 months after the effective date of this Act.
24
(c) The Department of Public Health shall adopt rules
25
necessary to implement and administer the African-American

HIV/AIDS Response Fund.

(d) As soon as practical after the effective date of this
3
amendatory Act of the 104th General Assembly, the Department
4
of Public Health shall adopt amendments to the rules set forth
5
in the African-American HIV/AIDS Response Code (77 Ill. Adm.
6
Code Part 691) to provide that:
7
(1) As used in the African-American HIV/AIDS Response
8
Code, "African-American community-based organization"
9
means an organization that is in good standing with the
10
State of Illinois, has a board of directors of which a
11
majority of the founding members were African-American
12
individuals, provides a majority of its services to
13
African-American individuals and families who are or have
14
been impacted by HIV, is physically located in the
15
community to be served, provides HIV/AIDS services in
16
communities that are primarily populated by individuals
17
and families that identify as African-American, and has
18
been in existence for at least one year at the time of
19
applying for an African-American HIV/AIDS Response Grant
20
under the African-American HIV/AIDS Response Code.
21
(2) The Department of Public Health shall accept
22
applications for the award of African-American HIV/AIDS
23
Response Grants under the African-American HIV/AIDS
24
Response Code between March 1 and April 30 of each year.
25
(3) Any funds that are awarded to a grant recipient
26
under the African-American HIV/AIDS Response Code from the

African-American HIV/AIDS Response Fund for an
2
African-American HIV/AIDS Response Grant for a fiscal year
3
but that are not expended by the grant recipient in that
4
year may be used by the grant recipient for the same
5
purposes in the immediately following fiscal year without
6
subsequent application by the grant recipient.
7
(4) African-American HIV/AIDS Response Grants shall be
8
annually awarded to at least 15 different African-American
9
community-based organizations.

Section 10.
The African-American HIV/AIDS Response Act is
14
amended by repealing Sections 10 and 25.
15
Section 99.
Effective date.
This Act takes effect upon
16
becoming law.
