Mike Porfirio SYNOPSIS AS INTRODUCED: 20 ILCS 3310/95 new Amends the Nuclear Safety Law of 2004. Provides that the Illinois Emergency Management Agency and Office of Homeland Security has the right to enter on public and private property in order to take environmental samples in response to a disaster that causes radioactive contamination. Effective immediately. LRB104 18370 BDA 31812 b A BILL FOR SB3643 LRB104 18370 BDA 31812 b 1 AN ACT concerning State government. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Nuclear Safety Law of 2004 is amended by 5 adding Section 95 as follows: 6 (20 ILCS 3310/95 new) 7 Sec. 95. Right of entry. 8 (a) As used in this Section, "disaster" has the meaning 9 given to that term in Section 4 of the Illinois Emergency 10 Management Agency Act. 11 (b) IEMA-OHS has the right to enter on public and private 12 property in order to take environmental samples in response to 13 a disaster that causes radioactive contamination. 14 Section 99. Effective date. This Act takes effect upon 15 becoming law.
