SYNOPSIS AS INTRODUCED:

30 ILCS 575/8m new

Amends the Business Enterprise for Minorities, Women, and Persons
with Disabilities Act. Provides that the Business Enterprise Program shall
recognize private funding given in the form of sponsorship of the
University of Illinois System Diverse Supplier Development Program (DSDP)
as dollars toward goal attainment under the Act if those funds are
distributed to eligible program graduates under specified conditions.

AN ACT concerning finance.

Be it enacted by the People of the State of Illinois,

represented in the General Assembly:

Section 5.
The Business Enterprise for Minorities, Women,
5
and Persons with Disabilities Act is amended by adding Section
6
8m as follows:

7

(30 ILCS 575/8m new)

Sec. 8m.
Sponsorship recognition.
Notwithstanding any rule
9
or provision of law to the contrary, the Business Enterprise
10
Program shall recognize private funding given in the form of
11
sponsorship of the University of Illinois System Diverse
12
Supplier Development Program (DSDP) as dollars toward the
13
attainment of goals under this Act if those funds are
14
distributed to eligible program graduates and meet the
15
following criteria:
16

(1) Any sponsorship dollars collected shall be
17

directly distributed to DSDP graduates upon graduation
18

from the program as business advancement funding. Funding
19

shall be dependent on sponsorships and is not guaranteed
20

nor likely to be equal from one cohort to the next. Funding
21

shall be distributed evenly among participants, shall be
22

distributed in whole, and shall not be subject to
23

administrative fees.

(2) All DSDP participants shall, at the time of
2

graduation from the program, hold certification in good
3

standing with the Business Enterprise Program and the
4

Illinois Commission on Equity and Inclusion.
5

(3) All entities providing sponsorship of the program
6

in return for dollars subject to goal shall have met their
7

existing contract goals or shall have an approved waiver
8

of those goals prior to receiving credit towards goal
9

attainment. Sponsor dollars shall not be counted twice. If
10

a sponsor is contracting with more than one State entity,
11

the sponsor shall clearly and in writing allocate those
12

funds to ensure proper accounting.

(4) Each State agency contracting with a sponsor
14

meeting the criteria in this Section shall include
15

applicable dollars in its annual business enterprise
16

expenditure report. Consideration shall be given to this
17

paragraph to ensure proper accounting.
18

(5) The DSDP will annually, but no later than January
19

1 of the following calendar year, report in writing to the
20

Commission on Equity and Inclusion a summary of the
21

sponsorship and business advancement funding initiative.
22

The report shall include, but shall not be limited to,
23

moneys received through sponsorship and the associated
24

entity responsible. The report shall also include a list
25

of program graduates receiving funding, as well as the
26

total amount provided.

This amendatory Act of the 104th General Assembly applies
2
to graduating cohorts that graduate after passage and approval
3
of this amendatory Act of the 104th General Assembly. All
4
criteria shall be met to receive funding, including complete
5
program graduation. For purposes of tax treatment and
6
compliance, all funds shall be treated as reciprocal
7
sponsorships and shall not be used as a charitable donation.
