Provides, in Articles concerning Downstate Public Transportation Assistance and Nonurbanized Area Public Transportation Assistance, that the term "operating deficits" does not include revenue from advertising. LRB104 20651 JDS 34148 b A BILL FOR SB3749 LRB104 20651 JDS 34148 b 1 AN ACT concerning finance. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Downstate Public Transportation Act is 5 amended by changing Sections 2-2.03, 3-1.03, and 4-1.11 as 6 follows: 7 (30 ILCS 740/2-2.03) (from Ch. 111 2/3, par. 662.03) 8 Sec. 2-2.03. "Operating deficits" means the amount by 9 which eligible operating expenses exceed revenue from fares, 10 reduced fare reimbursements, rental of properties, 11 advertising, and any other amounts collected and received by a 12 provider of public transportation, which, under standard 13 accounting practices, are properly classified as operating 14 revenue or operating income attributable to providing public 15 transportation and revenue from any federal financial 16 assistance received by the participant to defray operating 17 expenses or deficits. For purposes of determining operating 18 deficits, local effort from local taxes or its equivalent 19 shall not be included as operating revenue or operating 20 income. Provided, however, under the provisions of this Act 21 with respect to any operating deficit incurred by any 22 Metro-East Transit District participant, such operating 23 deficits shall be limited solely to those arising out of SB3749 - 2 - LRB104 20651 JDS 34148 b 1 operations within the State of Illinois. 2 (Source: P.A. 86-590.) 3 (30 ILCS 740/3-1.03) (from Ch. 111 2/3, par. 684) 4 Sec. 3-1.03. "Operating deficits" means the amount by 5 which eligible operating expenses exceed revenues from 6 nonreimbursable fares, rental of properties, advertising, and 7 any other amounts collected or received in the process of 8 providing public transportation under this Article which, 9 under standard accounting practices for the providing of 10 public transportation are properly classified as operating 11 revenue or operating income attributable to providing public 12 transportation under this Article. For purposes of determining 13 operating deficits, operating revenue or operating income 14 shall not include such funds as the Department may determine 15 consistent with federal Department of Transportation 16 regulations and requirements affecting Section 18. 17 (Source: P.A. 82-783.) 18 (30 ILCS 740/4-1.11) (from Ch. 111 2/3, par. 699.11) 19 Sec. 4-1.11. "Operating revenues" means income from 20 nonreimbursable fares, rental of properties, advertising, 21 local and state funds contributed to meet eligible operating 22 expenses, and any other amounts collected or received in the 23 process of providing public transportation under this Article, 24 and any revenue which is an operating revenue according to SB3749 - 3 - LRB104 20651 JDS 34148 b 1 standard accounting practices for the providing of public 2 transportation and which the Secretary may determine, 3 consistent with the federal Department of Transportation 4 regulations and requirements. 5 (Source: P.A. 86-16.)
