SYNOPSIS AS INTRODUCED:
410 ILCS 22/90
Amends the End-of-Life Options for Terminally Ill Patients Act.
Provides that, when a death has occurred in accordance with the Act, the
death shall be attributed to both the underlying terminal disease and
medical aid in dying pursuant to the Act (rather than only the underlying
terminal disease). Requires medical aid in dying pursuant to the Act shall
be listed on the death certificate of a qualified patient who obtained and
self-administered a prescription for medication pursuant to the Act.

AN ACT concerning health.

Be it enacted by the People of the State of Illinois,

represented in the General Assembly:

Section 5.
The End-of-Life Options for Terminally Ill
5
Patients Act is amended by changing Section 90 as follows:

Sec. 90.
Death certificate.
10
(a) Unless otherwise prohibited by law, the attending
11
physician may sign the death certificate of a qualified
12
patient who obtained and self-administered a prescription for
13
medication pursuant to this Act.
14
(b) When a death has occurred in accordance with this Act,
15
the death shall be attributed to
both
the underlying terminal
16
disease
and medical aid in dying pursuant to this Act
.
17
(1) Death following self-administering medication
18
under this Act does not alone constitute grounds for
19
postmortem inquiry.
20
(2) Death in accordance with this Act shall not be
21
designated a suicide or homicide.
22
(c)
Medical aid in dying pursuant to this Act shall be
23
listed on the death certificate of a qualified patient who

obtained and self-administered a prescription for medication

pursuant to this Act.
A qualified patient's act of
3
self-administering medication prescribed pursuant to this Act
4
shall not be indicated on the death certificate.
