SYNOPSIS AS INTRODUCED:

20 ILCS 2105/2105-368

Amends the Department of Professional Regulation Law of the Civil
Administrative Code of Illinois. In conjunction with applications for
health care professional licensure and renewals, requires the Department
of Financial and Professional Regulation shall require applicants to
provide practice information that include areas of practice specialty,
addresses of all current practice locations, hours spent at each practice
location on direct outpatient care, the applicant's National Provider
Identifier (NPI) number if applicable, and anticipated date of retirement.
Provides that the Department shall share the information with authorized
personnel at the Department of Public Health. Specifies that the data is
exempt from the Freedom of Information Act. Defines "health care
professional". Provides that data published in conjunction with
applications for health care professional licensure shall not identify a
health care professional's name or any other data that leads to
identification.

Be it enacted by the People of the State of Illinois,

represented in the General Assembly:

Section 5.
The Department of Professional Regulation Law
5
of the Civil Administrative Code of Illinois is amended by
6
changing Section 2105-368 as follows:

Sec. 2105-368.
Data on applications.

(a)
In conjunction with applications for licensure and
10
renewals, the Department shall request, and applicants may
11
voluntarily provide, demographic information that includes
12
sex, ethnicity, race, disability, primary language spoken,
13
anticipated date of retirement, type of employment, and zip
14
code.

(b) In conjunction with applications for health care
16
professional licensure and renewals, the Department shall
17
require applicants to provide practice information that
18
include areas of practice specialty, addresses of all current
19
practice locations, hours spent at each practice location on
20
direct outpatient care, the applicant's National Provider
21
Identifier (NPI) number if applicable, and anticipated date of
22
retirement. The Department shall share this information with
23
authorized personnel at the Department of Public Health. Data

specifically collected for this subsection shall be exempt
2
from the Freedom of Information Act.

(c)
On or before March 1 of each calendar year, the
4
Department shall publish a report on the Department's website
5
that contains
aggregate data, including
the demographic
6
information it collected
pursuant to subsection (a) in
the
7
preceding calendar year, the number of applications for
8
licensure and renewal of licensure it received in the
9
preceding calendar year, and the number of applicants who were
10
denied licensure in the preceding calendar year regardless of
11
whether application was made in that calendar year.
None of
12
the data published pursuant to this Section shall identify a
13
health care professional's name or any other data that leads
14
to identification.

(d) As used in this subsection, "health care professional"
16
means a person licensed or registered by the Department under
17
the following Acts: the Medical Practice Act of 1987, the
18
Nurse Practice Act, the Clinical Psychologist Licensing Act,
19
the Illinois Optometric Practice Act of 1987, the Illinois
20
Physical Therapy Act, the Physician Assistant Practice Act of
21
1987, the Clinical Social Work and Social Work Practice Act,
22
the Nursing Home Administrators Licensing and Disciplinary
23
Act, the Illinois Occupational Therapy Practice Act, the
24
Podiatric Medical Practice Act of 1987, the Respiratory Care
25
Practice Act, the Professional Counselor and Clinical
26
Professional Counselor Licensing and Practice Act, and the
