Section

1.

Section

80F.1,

Code

2026,

is

amended

by

adding

1

the

following

new

subsection:

NEW

SUBSECTION

.

26.

If

the

district

court

finds

in

favor

3

of

the

officer

in

an

action

brought

under

subsection

25,

4

upon

application,

the

district

court

shall

award

the

officer

5

equitable

relief,

reasonable

attorney

fees,

expenses,

and

court

6

costs,

which

shall

be

paid

by

the

prosecuting

agency.

This

7

subsection

applies

retroactively

to

district

court

rulings

8

issued

on

or

after

July

1,

2021.

inclusion

of

this

explanation

does

not

constitute

agreement

with

the

explanation’s

substance

by

the

members

of

the

general

assembly.

This

bill

relates

to

the

peace

officer,

public

safety,

and

13

emergency

personnel

bill

of

rights,

including

fees,

expenses,

14

and

court

costs.

The

bill

provides

that

when

an

officer

who

has

appealed

the

16

officer’s

placement

on

a

Brady-Giglio

list

to

the

district

17

court,

and

the

district

court

finds

in

favor

of

the

officer

and

18

orders

the

officer’s

name

removed

from

the

Brady-Giglio

list,

19

then,

upon

application,

the

district

court

shall

award

the

20

officer

equitable

relief,

reasonable

attorney

fees,

expenses,

21

and

court

costs,

which

shall

be

paid

by

the

prosecuting

agency.

The

bill

applies

retroactively

to

district

court

rulings

23

issued

on

or

after

July

1,

2021.
