Section

1.

NEW

SECTION

.

321.275A

Mini-trucks.

1

1.

A

person

shall

not

operate

a

mini-truck

on

a

highway

2

with

a

speed

limit

greater

than

fifty-five

miles

per

hour.

However,

this

subsection

does

not

prohibit

a

person

operating

a

4

mini-truck

from

crossing

a

highway

with

a

speed

limit

greater

5

than

fifty-five

miles

per

hour

at

an

intersection.

Notwithstanding

section

321.115,

subsection

1,

paragraph

7

“a”

,

a

mini-truck

shall

not

be

registered

as

an

antique

vehicle.

For

purposes

of

this

section,

“mini-truck”

means

a

9

motor

vehicle

designed,

used,

or

maintained

primarily

for

the

10

transportation

of

property

and

having

four

wheels,

an

engine

11

displacement

of

six

hundred

sixty

cubic

centimeters

or

less,

an

12

overall

length

of

one

hundred

thirty

inches

or

less,

an

overall

13

height

of

seventy-eight

inches

or

less,

and

an

overall

width

14

of

sixty

inches

or

less.

EXPLANATION

The

inclusion

of

this

explanation

does

not

constitute

agreement

This

bill

prohibits

a

person

from

operating

a

mini-truck

on

a

highway

with

a

speed

limit

greater

than

55

miles

per

hour,

other

than

when

crossing

at

an

intersection.

The

bill

also

prohibits

a

mini-truck

from

being

registered

as

an

22

antique

vehicle.

As

used

in

the

bill,

a

“mini-truck”

is

a

23

motor

vehicle

designed,

used,

or

maintained

primarily

for

the

24

transportation

of

property

and

having

four

wheels,

an

engine

25

displacement

of

660

cubic

centimeters

or

less,

an

overall

26

length

of

130

inches

or

less,

an

overall

height

of

78

inches

or

27

less,

and

an

overall

width

of

60

inches

or

less.

By

operation

of

law,

a

person

who

violates

the

bill

commits

29

a

simple

misdemeanor.

A

simple

misdemeanor

is

punishable

by

30

confinement

for

no

more

than

30

days

and

a

fine

of

at

least

$105

but

not

more

than

$855.

Because

a

mini-truck

is

defined

as

a

motor

vehicle

for

33

purposes

of

Code

chapter

321

(motor

vehicles

and

law

of

the

road),

a

mini-truck

operated

on

a

highway

is

required

to

be

equipped

with

parts,

lamps,

and

other

equipment

in

proper

condition

and

adjustment

as

required

for

motor

vehicles

under

Code

chapter

321.
