Section

1.

Section

321.194,

subsection

7,

paragraph

b,

Code

is

amended

to

read

as

follows:

b.

As

a

result

of

the

suspension,

the

department

shall

3

not

issue

an

intermediate

license

under

section

321.180B

,

4

subsection

2,

for

an

additional

three

months

to

a

person

5

whose

special

minor’s

restricted

license

was

suspended

6

under

this

subsection

,

per

violation,

following

the

person’s

7

sixteenth

birthday.

However,

during

the

suspension

period,

8

the

department

may

issue

an

instruction

permit

under

section

9

321.180B,

subsection

1,

if

the

person

whose

special

minor’s

10

restricted

license

was

suspended

applies

for

an

instruction

11

permit,

is

otherwise

eligible

to

be

issued

an

instruction

12

permit,

and

pays

the

required

fee.

Sec.

2.

APPLICABILITY.

This

Act

applies

on

and

after

14

March

1,

2027,

or

the

publication

date

of

the

issue

of

the

15

Iowa

administrative

bulletin

that

includes

a

statement

16

by

the

director

of

transportation

that

the

department

of

17

transportation’s

new

driver’s

license

information

technology

18

system

is

implemented,

whichever

is

earlier.

The

department

19

shall

forward

a

copy

of

the

statement

to

the

Iowa

Code

editor

20

prior

to

publication.

EXPLANATION

The

inclusion

of

this

does

not

constitute

agreement

the

members

the

general

assembly.

Under

current

law,

a

person

between

the

ages

of

14

25

and

18

who

holds

a

special

minor’s

restricted

license

26

(licensee)

is

authorized

to

operate

a

motor

vehicle

without

27

supervision

between

certain

approved

locations

for

a

number

28

of

purposes

during

specified

times.

If

a

licensee

violates

29

the

restrictions

of

a

special

minor’s

restricted

license,

30

is

at

fault

in

an

accident

or

collision,

or

is

convicted

31

for

violating

a

state

law

or

city

ordinance

regulating

the

32

operation

of

motor

vehicles

on

highways,

other

than

parking

33

violations,

the

department

of

transportation

(DOT)

is

required

34

to

suspend

the

license

for

three

months

and

is

prohibited

from

an

intermediate

license

to

the

person

for

an

additional

three

months

following

the

person’s

16th

birthday.

This

bill

authorizes

the

DOT

to

issue

an

instruction

permit

3

to

a

person

whose

special

minor’s

restricted

license

is

4

suspended.

An

instruction

permit

entitles

a

person

under

the

5

age

of

18

to

operate

a

motor

vehicle

upon

the

highways

while

6

accompanied.

The

accompanying

person

must

occupy

the

front

7

seat

beside

the

driver,

hold

a

driver’s

license

valid

for

the

8

vehicle

operated,

and

be

the

parent,

guardian,

or

custodian

of

9

the

permittee,

a

member

of

the

permittee’s

immediate

family

10

if

the

family

member

is

at

least

21

years

of

age,

an

approved

11

driver

education

instructor,

a

prospective

driver

education

12

instructor

who

is

enrolled

in

a

practitioner

preparation

13

program

with

a

safety

education

program

approved

by

the

state

14

board

of

education,

or

a

person

at

least

25

years

of

age

if

15

written

permission

is

granted

by

the

parent,

guardian,

or

16

custodian.

The

fee

for

an

instruction

permit

is

$6.

The

bill

applies

on

and

after

March

1,

2027,

or

the

18

publication

date

of

the

issue

of

the

Iowa

administrative

19

bulletin

that

includes

a

statement

by

the

director

of

20

transportation

that

the

DOT’s

new

driver’s

license

information

21

technology

system

is

implemented,

whichever

is

earlier.

The

22

DOT

is

required

to

forward

a

copy

of

the

statement

to

the

Iowa

23

Code

editor

prior

to

publication.
