Code

is

amended

by

adding

the

following

new

subsection:

11E.

Iowa’s

delta

waterfowl

plates.

a.

Upon

application

and

payment

of

the

proper

fees,

the

4

director

may

issue

Iowa’s

delta

waterfowl

plates

to

the

owner

5

of

a

motor

vehicle

subject

to

registration

under

section

6

321.109,

subsection

1,

autocycle,

motor

truck,

motor

home,

7

multipurpose

vehicle,

motorcycle,

trailer,

or

travel

trailer.

8

b.

Iowa’s

delta

waterfowl

plates

shall

be

designed

by

the

9

department

in

cooperation

with

the

Iowa

chapters

of

the

delta

10

waterfowl

organization.

11

c.

The

special

Iowa’s

delta

waterfowl

fee

for

letter-number

12

designated

Iowa’s

delta

waterfowl

plates

is

twenty-five

13

dollars.

An

applicant

may

obtain

personalized

Iowa’s

delta

14

waterfowl

plates

upon

payment

of

the

fee

for

personalized

15

plates

as

provided

in

subsection

5,

which

is

in

addition

to

the

16

special

Iowa’s

delta

waterfowl

fee.

d.

The

fees

collected

by

the

director

under

this

subsection

18

shall

be

paid

monthly

to

the

treasurer

of

state

and

deposited

19

in

the

road

use

tax

fund.

The

treasurer

of

state

shall

20

transfer

monthly

from

the

statutory

allocations

fund

created

21

under

section

321.145,

subsection

2,

to

the

general

fund

of

22

the

state

the

amount

of

the

special

fees

collected

in

the

23

previous

month

for

Iowa’s

delta

waterfowl

plates.

Such

moneys

24

are

appropriated

to

the

department

of

natural

resources

to

25

distribute

in

the

form

of

grants

to

support

delta

waterfowl

26

habitat

conservation

and

hunting

in

Iowa.

In

the

awarding

27

of

grants,

the

department

of

natural

resources

shall

give

28

first

consideration

to

any

state

chapter

of

a

nonprofit

29

organization

supporting

delta

waterfowl

habitat

conservation

30

and

improvement,

and

efforts

to

increase

the

number

of

31

hunters

in

this

state,

and

similar

nonprofit

organizations.

32

Notwithstanding

section

8.33,

moneys

appropriated

under

this

33

subsection

shall

not

revert.

Upon

receipt

of

the

special

registration

plates,

the

applicant

shall

surrender

the

current

registration

plates

to

1

the

county

treasurer.

The

county

treasurer

shall

validate

2

the

special

registration

plates

in

the

same

manner

as

regular

registration

plates

are

validated

under

this

section.

The

4

annual

special

Iowa’s

delta

waterfowl

fee

for

letter-number

5

designated

plates

is

ten

dollars

which

shall

be

paid

in

6

addition

to

the

regular

annual

registration

fee.

The

annual

7

fee

for

personalized

Iowa’s

delta

waterfowl

plates

is

ten

8

dollars

which

shall

be

paid

in

addition

to

the

annual

special

9

Iowa’s

delta

waterfowl

fee

and

the

regular

annual

registration

10

fee.

The

annual

special

Iowa’s

delta

waterfowl

fee

shall

be

11

credited

as

provided

under

paragraph

“d”

.

The

department

shall

not

condition

the

issuance

of

Iowa’s

13

delta

waterfowl

plates

on

the

receipt

of

any

number

of

orders

14

for

Iowa’s

delta

waterfowl

plates.

EXPLANATION

The

inclusion

of

this

explanation

agreement

with

the

the

general

This

bill

authorizes

the

department

of

transportation

(DOT)

19

to

design

and

issue

Iowa’s

delta

waterfowl

(IDW)

special

20

registration

plates.

The

design

must

be

in

cooperation

with

21

the

Iowa

chapters

of

the

delta

waterfowl

organization.

Delta

22

waterfowl

is

a

national

nonprofit

organization

dedicated

to

the

23

conservation

of

delta

waterfowl

and

the

preservation

of

delta

24

waterfowl

hunters’

hunting

heritage.

25

The

bill

provides

that

the

special

IDW

fee

for

letter-number

26

designated

IDW

plates

is

$25.

An

applicant

may

obtain

27

personalized

IDW

plates

by

paying

an

additional

$25

fee

for

28

personalized

registration

plates

as

provided

in

Code

section

29

321.34(5),

which

is

in

addition

to

the

special

IDW

fee.

The

30

annual

special

IDW

fee

for

letter-number

designated

plates

is

31

$10,

which

is

in

addition

to

the

regular

annual

registration

32

fee.

Similarly,

the

annual

fee

for

personalized

IDW

plates

is

33

$10,

which

is

in

addition

to

both

the

annual

special

IDW

fee

and

the

regular

annual

registration

fee.

The

fees

collected

by

the

DOT

must

be

paid

monthly

to

the

1

treasurer

of

state

and

deposited

in

the

road

use

tax

fund.

The

2

treasurer

of

state

must

transfer

monthly

from

the

statutory

3

allocations

fund

to

the

general

fund

of

the

state

an

amount

4

equal

to

the

special

fees

collected

in

the

previous

month

5

for

the

IDW

plates.

Such

moneys

are

appropriated

to

the

6

department

of

natural

resources

(DNR)

to

distribute

in

the

7

form

of

grants

to

support

delta

waterfowl

habitat

conservation

8

and

hunting

in

Iowa.

In

awarding

the

grants,

DNR

must

give

9

first

consideration

to

any

state

chapter

of

a

nonprofit

10

organization

supporting

delta

waterfowl

habitat

conservation

11

and

improvement,

and

efforts

to

increase

the

number

of

hunters

12

in

Iowa,

and

similar

nonprofit

organizations.

The

bill

prohibits

the

DOT

from

conditioning

the

issuance

14

of

IDW

plates

on

the

receipt

of

any

number

of

orders

for

IDW

15

plates.

16

Under

current

law,

nonprofit

organizations

are

authorized

17

to

apply

to

the

DOT

for

approval

to

issue

a

decal

of

the

18

organization’s

own

design

to

be

displayed

on

special

19

registration

plates

with

space

reserved

for

an

organizational

20

decal.

The

nonprofit

organization

may

charge

a

fee

and

retain

21

any

payment

received

for

the

organizational

decal.

Code

22

section

321.34(13)

sets

forth

the

application

process

and

23

certain

limitations

for

nonprofit

organizations

and

decal

24

designs.

Additionally,

the

DOT

currently

offers

special

ducks

25

unlimited

plates,

upon

application

and

payment

of

the

required

26

fees.
