not

an

eligible

as

defined

in

section

39.3,

that

is

a

resident

of

the

state,

district,

county,

ward,

or

other

political

subdivision

that

is

represented

by

the

office

sought

by

the

candidate,

as

reflected

in

the

statement

of

organization

filed

pursuant

to

section

68A.201.

This

bill

classifies

as

an

illegal

contribution

a

contribution

made

to

a

candidate

or

candidate’s

committee

by

a

person

who

is

not

an

eligible

elector

that

resides

in

the

state,

or

political

subdivision

of

the

state,

that

is

represented

by

the

office

sought

by

the

candidate,

as

reflected

17

in

the

statement

of

organization

filed

by

the

candidate’s

18

committee.

By

operation

of

law,

a

person

who

willfully

violates

the

20

bill

is

guilty

of

a

serious

misdemeanor.

A

serious

misdemeanor

21

is

punishable

by

confinement

for

no

more

than

one

year

and

a

22

fine

of

at

least

$430

but

not

more

than

$2,560.

In

addition,

23

the

person

may

be

subject

to

civil

penalties

imposed

by

the

24

Iowa

ethics

and

campaign

disclosure

board,

including

remedial

25

action,

a

reprimand,

and

a

civil

penalty

of

up

to

$2,000
