Code

is

amended

to

read

as

follows:

Name

change.

1.

a.

Either

party

to

a

marriage

may

request

as

a

part

of

the

decree

of

dissolution

or

decree

of

annulment

a

change

in

5

the

person’s

name

to

either

the

name

appearing

on

the

person’s

6

birth

certificate

or

to

the

name

the

person

had

immediately

7

prior

to

the

marriage.

b.

If

a

party

requests

a

name

change

other

than

to

the

name

9

appearing

on

the

person’s

birth

certificate

or

to

the

name

the

10

person

had

immediately

prior

to

the

marriage,

the

request

shall

11

be

made

under

chapter

674

.

If

a

party

requests

a

name

change

under

subsection

1,

paragraph

“a”

,

the

clerk

of

court

shall

issue

a

separate

document

evidencing

the

name

change.

The

document

shall

not

contain

any

other

information

relating

to

the

decree

of

dissolution

or

decree

of

annulment.

EXPLANATION

The

inclusion

of

this

explanation

does

constitute

the

general

As

part

of

a

decree

of

dissolution

or

decree

of

annulment,

a

party

to

a

marriage

may

request

a

change

in

the

person’s

22

name

to

either

the

name

appearing

on

the

person’s

birth

23

certificate

or

to

the

name

the

person

had

immediately

prior

24

to

the

marriage.

This

bill

provides

that

if

a

party

does

so,

25

the

clerk

of

court

is

required

to

issue

a

separate

document

26

evidencing

the

party’s

name

change.

The

bill

requires

that

the

27

document

issued

does

not

contain

any

other

information

relating

28

to

the

decree

of

dissolution

or

decree

of

annulment.
