The

shall

publish

its

internet

a

manure

management

planning

map

to

assist

a

person

applying

manure

originating

from

an

animal

feeding

operation.

management

planning

map

shall

be

part

of

an

interactive

computer

program.

The

map

shall

be

in

the

form

of

a

digital

dynamic

map

that

incorporates

geographic

information

system

technology

in

a

manner

that

allows

a

user

to

immediately

identify

areas

that

are

vulnerable

to

pollution

caused

by

manure

application

due

to

one

or

more

factors

identified

by

the

department,

including

but

not

limited

to

any

of

the

following:

Terrain,

including

karst

terrain,

and

topography.

climatic

conditions.

a

designated

area

a

a

person

practical

reducing

associated

with

runoff,

by

adjusting

and

timing.

BACKGROUND.

An

animal

feeding

operation

(AFO)

is

regulated

34

by

the

department

of

natural

resources

(DNR)

under

several

Code

including

Code

chapter

459

governing

all

AFOs,

which

1

includes

provisions

regulating

confinement

feeding

operations,

2

and

Code

chapter

459A,

which

includes

selected

provisions

3

regulating

open

feedlot

operations.

An

AFO

is

an

area

in

4

which

agricultural

animals

are

confined

for

45

days

or

more

5

in

any

12-month

period,

and

all

associated

structures

used

6

for

the

storage

of

manure.

A

confinement

feeding

operation

7

maintains

animals

in

roofed

buildings

and

stores

liquid

manure

8

in

a

formed

or

unformed

structure

(see

Code

section

459.102).

An

open

feedlot

operation

is

an

unroofed

or

partially

roofed

10

facility

without

crop,

vegetation,

or

forage

growth

or

residue

11

cover

(Code

section

459A.102).

Manure

from

an

open

feedlot

12

operation

includes

solids

that

are

usually

not

stored

in

a

13

structure.

Both

Code

chapters

regulate

the

application

of

14

manure,

often

pursuant

to

a

plan

required

to

be

filed

with

15

DNR.

In

the

case

of

a

confinement

feeding

operation,

the

plan

16

is

referred

to

as

a

manure

management

plan

(MMP)

(Code

section

17

459.313)

and

in

the

case

of

an

open

feedlot

operation,

the

18

plan

is

referred

to

as

a

nutrient

management

plan

(NMP)

(Code

19

section

459A.208).

BILL’S

PROVISIONS.

This

bill

requires

DNR

to

prepare

and

21

publish

on

its

internet

site

a

manure

management

planning

22

map

(MMPM)

to

assist

a

person

applying

manure

originating

23

from

an

animal

feeding

operation.

The

MMPM

must

be

part

of

24

an

interactive

program

in

the

form

of

a

digital

dynamic

map

25

that

identifies

areas

vulnerable

to

the

application

of

manure

26

based

on

a

number

of

factors

determined

by

DNR.

The

factors

27

must

at

least

include

terrain

and

topography,

the

effect

of

28

climatic

conditions,

and

proximity

to

a

designated

area

or

a

29

water

source.

A

designated

area

refers

to

a

known

sinkhole,

30

a

cistern,

an

abandoned

well,

an

unplugged

agricultural

31

drainage

well,

an

agricultural

drainage

well

surface

inlet,

32

a

drinking

water

well,

a

designated

wetland

(designated

as

33

a

protected

wetland

by

the

United

States

department

of

the

interior

or

DNR),

or

a

water

source

(a

lake,

river,

reservoir,

ditch,

or

other

body

of

water

or

channel

having

definite

banks

and

a

bed

with

water

flow).

A

person

completing

an

MMP

(in

the

case

of

a

confinement

feeding

operation)

or

NMP

(in

the

case

of

an

open

feedlot

operation)

must

verify

that

the

4

person

consults

with

the

MMPM

prior

to

application.
