135.61,

Code

is

amended

by

adding

the

following

new

subsection:

SUBSECTION

“Cancer

care

provider”

means

any

of

the

following:

a.

An

outpatient

oncology

clinic.

5

b.

A

radiation

therapy

center.

6

c.

A

chemotherapy

infusion

center.

7

d.

An

outpatient

cancer

diagnostic

facility.

8

e.

An

oncology

surgical

center.

9

f.

An

ancillary

support

service

directly

related

to

cancer

10

treatment.

Sec.

2.

Section

135.62,

Code

2026,

is

amended

by

adding

the

12

following

new

subsection:

NEW

SUBSECTION

.

3A.

This

subchapter

shall

not

apply

to

a

14

cancer

care

provider.

EXPLANATION

The

inclusion

of

this

explanation

does

not

constitute

agreement

with

17

the

explanation’s

substance

by

the

members

of

the

general

assembly.

Under

current

law,

a

health

care

provider

(provider)

19

is

required

to

obtain

a

certificate

of

need

(CON)

from

the

20

department

of

health

and

human

services

if

the

provider

plans

21

to

offer

a

new

institutional

health

service

or

a

changed

22

institutional

health

service.

23

This

bill

defines

“cancer

care

provider”

and

exempts

cancer

24

care

providers

from

CON

requirements.
