Notwithstanding

any

other

provision

of

law

to

the

contrary,

it

is

unlawful

for

any

person

to

manufacture,

distribute,

prescribe,

dispense,

sell,

or

transfer

mifepristone,

mifegyne,

or

mifeprex,

or

any

substantially

10

similar

generic

or

nongeneric

abortifacient

drug

in

the

state.

2.

A

person

who

violates

this

section

is

guilty

of

a

class

12

“C”

felony.

3.

This

section

shall

not

be

construed

to

impose

civil

14

or

criminal

liability

on

a

woman

upon

whom

an

abortion

is

15

performed

or

attempted

in

which

an

abortifacient

drug

otherwise

16

prohibited

under

this

section

is

used.

4.

This

section

shall

not

be

construed

to

prohibit

the

sale,

18

use,

prescription,

or

administration

of

any

contraceptive

agent

19

administered

prior

to

conception

or

before

a

pregnancy

can

be

20

confirmed

through

conventional

medical

testing.

EXPLANATION

The

inclusion

this

explanation

does

constitute

agreement

with

members

the

general

This

bill

provides

that

notwithstanding

any

other

provision

of

law

to

the

contrary,

it

is

unlawful

for

any

person

to

26

manufacture,

distribute,

prescribe,

dispense,

sell,

or

transfer

generic

or

nongeneric

abortifacient

drugs

in

the

state.

A

28

person

who

violates

the

bill

is

guilty

of

a

class

“C”

felony.

29

A

class

“C”

felony

is

punishable

by

confinement

for

no

more

30

than

10

years

and

a

fine

of

at

least

$1,370

but

not

more

than

31

$13,660.

32

The

bill

shall

not

be

construed

to

impose

civil

or

criminal

33

liability

on

a

woman

upon

whom

an

abortion

is

performed

or

34

attempted

in

which

an

abortifacient

drug

otherwise

prohibited
