is

amended

by

striking

1

the

section

and

inserting

in

lieu

thereof

the

following:

moneys

from

citations.

1.

Moneys

received

by

a

local

authority

from

citations

4

issued

using

a

system

that

exceed

the

amount

necessary

to

5

operate,

use,

maintain,

and

administer

such

system

shall

be

6

transferred

monthly

to

the

treasurer

of

state

and

deposited

in

7

the

road

use

tax

fund

created

in

section

312.1.

2.

Each

month,

a

local

authority

that

received

moneys

from

9

citations

issued

using

a

system

shall

submit

a

report

to

the

10

department

containing

a

full

and

complete

statement

of

all

11

moneys

received

by

and

expenses

paid

relating

to

the

system

12

during

the

preceding

calendar

month.

inclusion

this

does

constitute

agreement

with

the

the

members

of

the

general

assembly.

Under

current

law,

a

local

authority

that

is

permitted

to

17

use

an

automated

or

remote

system

for

traffic

law

enforcement

(system)

in

accordance

with

Code

chapter

321P

(automated

19

traffic

enforcement)

is

prohibited

from

using

revenue

received

20

and

retained

by

the

local

authority

as

a

result

of

the

use

21

of

such

system,

not

including

the

cost

to

install,

operate,

22

and

maintain

the

system,

other

than

to

fund

transportation

23

infrastructure

improvement

projects

or

to

offset

costs

incurred

24

relating

to

the

operation

of

a

police

department

or

fire

25

department.

This

bill

instead

requires

local

authorities

to

deposit

27

moneys

received

from

citations

issued

using

a

system

into

the

28

road

use

tax

fund.

However,

such

entities

may

still

retain

29

moneys

necessary

to

operate,

use,

maintain,

and

administer

the

30

system.

The

bill

requires

permitted

local

authorities

that

31

received

moneys

from

such

citations

to

submit

a

report

to

the

32

department

of

transportation

containing

a

statement

of

all

33

moneys

received

by

and

expenses

paid

relating

to

the

system.
