current

law,

a

person

is

prohibited

from

operating

an

all-terrain

vehicle

(ATV)

with

more

persons

on

the

ATV

than

the

ATV

was

designed

to

carry,

unless

the

person

is

operating

an

ATV

as

part

of

a

farm

operation.

A

person

who

violates

18

this

provision

commits

a

simple

misdemeanor

punishable

by

a

19

scheduled

fine

of

$135.

This

bill

provides

an

exception

to

the

ATV

passenger

limit

21

for

a

person

operating

an

ATV

that

is

modified

to

carry

no

22

more

than

one

additional

person

so

long

as

the

modification

23

is

an

aftermarket

product

or

original

equipment

manufacturer

24

product

that

is

both

specifically

designed

to

carry

a

person

as

25

a

passenger

on

the

type

of

ATV

to

which

the

product

is

secured

26

and

is

manufactured

for

commercial

sale.
