owner

referred

to

in

the

reserve

forces

of

the

United

States

or

the

Iowa

national

guard,

regardless

of

the

number

of

years

of

service,

and

was

discharged

under

honorable

conditions

may,

upon

written

application

to

the

department

and

upon

presentation

of

satisfactory

proof

of

military

service

and

discharge

under

8

honorable

conditions,

order

special

registration

plates

bearing

9

a

distinguishing

processed

emblem

depicting

the

word

“veteran”

10

below

an

image

of

the

American

flag.

The

application

is

11

subject

to

approval

by

the

department.

The

special

plate

fees

12

collected

by

the

director

under

subsection

12

,

paragraph

“a”

,

13

from

the

annual

validation

of

letter-number

designated

United

14

States

veteran

plates,

and

subsection

12

,

paragraph

“c”

,

from

15

the

issuance

and

annual

validation

of

personalized

United

16

States

veteran

plates,

shall

be

paid

monthly

to

the

treasurer

17

of

state

and

deposited

in

the

road

use

tax

fund.

The

treasurer

18

of

state

shall

transfer

monthly

from

the

statutory

allocations

19

fund

created

under

section

321.145,

subsection

2

,

to

the

20

veterans

license

fee

fund

created

in

section

35A.11

the

amount

21

of

the

special

fees

collected

under

subsection

12

,

paragraph

22

“a”

,

in

the

previous

month

for

United

States

veteran

plates.

inclusion

of

this

explanation

constitute

the

general

assembly.

Under

current

law,

the

department

of

transportation

(DOT)

is

authorized

to

issue

special

registration

plates

with

a

28

distinguishing

processed

emblem

depicting

the

word

“veteran”

29

below

an

image

of

the

American

flag

to

a

motor

vehicle

owner

30

who

served

in

the

armed

forces

of

the

United

States

and

was

31

discharged

under

honorable

conditions.

Pursuant

to

rules

32

adopted

by

the

DOT

(761

IAC

401.31),

an

application

for

special

33

plates

with

a

veteran

processed

emblem

must

be

submitted

to

34

the

commission

of

veterans

affairs

on

a

form

prescribed

by

the

DOT.

The

commission

of

veterans

affairs

must

determine

whether

1

the

applicant

is

a

veteran

and,

if

so,

certify

this

fact

on

the

2

application

form.

This

bill

makes

persons

who

served

in

the

reserve

forces

of

4

the

United

States

or

the

Iowa

national

guard,

regardless

of

5

the

number

of

years

of

service,

and

who

were

discharged

under

6

honorable

conditions

eligible

to

receive

special

registration

7

plates

with

a

veteran

processed

emblem.

8

Under

current

law,

“veteran”,

when

used

in

Code

chapter

9

35

(veterans

affairs),

and

in

numerous

other

provisions

by

10

reference,

includes

former

members

of

the

reserve

forces

of

the

11

United

States

or

the

Iowa

national

guard

who

served

at

least

12

20

years

and

who

were

discharged

under

honorable

conditions;

13

members

of

the

reserve

forces

of

the

United

States

or

the

14

Iowa

national

guard

who

were

activated

for

federal

duty,

15

other

than

training,

for

a

minimum

aggregate

of

90

days,

and

16

were

discharged

under

honorable

conditions

or

were

retired

in

17

accordance

with

federal

law;

and

members

of

the

reserve

forces

18

of

the

United

States

or

the

Iowa

national

guard

who

have

served

19

at

least

20

years

and

who

continue

to

serve.
