3.

TRANSITION

PROVISION.

12

1.

Notwithstanding

any

provision

of

law

to

the

contrary,

13

a

county

with

the

main

campus

of

an

institution

of

higher

14

learning

governed

by

the

state

board

of

regents

that

does

not

15

use

plan

“three”

for

the

election

of

supervisors,

as

defined

in

16

section

331.206,

as

of

the

effective

date

of

this

Act,

shall

17

elect

supervisors

using

plan

“three”

during

the

2026

general

18

election,

using

a

representation

plan

drawn

pursuant

to

section

19

331.210A,

subsection

2,

paragraph

“f”,

and

the

requirements

of

20

this

section.

2.

A

county

required

to

use

a

representation

plan

as

22

provided

in

this

section

shall

establish

a

temporary

county

23

redistricting

commission

by

the

later

of

thirty

days

after

the

24

effective

date

of

this

Act

or

May

15,

2025,

and

shall

complete

25

a

precinct

plan,

in

conformity

with

the

requirements

of

26

sections

331.209

and

331.210A,

no

later

than

October

1,

2025.

The

precinct

plan

shall

be

submitted

to

the

state

commissioner

28

of

elections

and

the

legislative

services

agency

shall

draw

and

29

publish

the

representation

plan

by

January

1,

2026.

The

bill

requires

a

county

1

with

the

main

campus

of

an

institution

of

higher

learning

2

governed

by

the

state

board

of

regents

to

use

plan

“three”

for

3

the

election

of

county

supervisors.

Plan

“three”

requires

4

individual

members

of

the

board

of

supervisors

for

that

county

5

to

be

elected

from

single-member,

equal-population

districts.

Current

law

prohibits

a

county

with

a

population

of

60,000

or

7

more

that

uses

plan

“three”

from

adopting

a

new

representation

8

plan,

unless

the

new

plan

is

approved

by

a

two-thirds

vote

of

9

the

ballots

cast

in

the

special

election.

The

bill

makes

this

10

provision

inapplicable

to

counties

with

the

main

campus

of

an

11

institution

of

higher

learning

governed

by

the

state

board

of

12

regents.

The

bill

requires

counties

with

the

main

campus

of

an

institution

of

higher

learning

governed

by

the

state

board

of

regents

that

do

not

use

plan

“three”

for

the

election

of

supervisors

as

of

the

effective

date

of

the

bill

to

submit

a

precinct

plan

to

the

state

commissioner

of

elections

by

18

October

1.

The

legislative

services

agency

must

draw

the

19

representation

plan,

in

conformity

with

the

provisions

of

20

law

governing

the

adoption

of

a

plan

“three”

representation

21

plan,

for

use

by

such

counties

to

elect

supervisors

under

plan

22

“three”

during

the

2026

general

election.

The

bill

requires

special

elections

for

the

purpose

of

24

selecting

a

supervisor

representation

plan

to

be

held

on

the

25

first

Tuesday

after

the

first

Monday

in

November,

rather

than

26

the

first

Tuesday

in

August.

In

accordance

with

Code

section

27

39.2

(special

elections),

a

special

election

may

be

held

on

28

the

same

day

as

a

regularly

scheduled

election.

The

bill

also

requires

a

plan,

the

filled

the

campus

of

an

institution

of

higher

learning

governed

by

the

state

board

of

regents.

Current

law

allows

for

vacancies

to

be

filled

by

appointment

under

certain

circumstances.

The

bill

requires

vacancies

to

be

filled

by

8

appointment

in

a

county

with

a

population

of

less

than

125,000

that

does

not

include

the

main

campus

of

an

institution

of

higher

learning

governed

by

the

state

board

of

regents

in

accordance

with

current

law,

including

a

vacancy

that

is

resignation

the
