is

amended

by

adding

the

following

new

subsection:

NEW

SUBSECTION

A

person

who

is

eighteen

years

of

age

3

or

older

commits

a

serious

misdemeanor

if

the

person

knowingly

4

sends

a

picture

or

video,

which

the

person

knows

or

reasonably

5

should

know

is

unsolicited

and

unwanted

by

the

recipient,

by

6

electronic

means

depicting

any

of

the

following:

a.

Any

person’s

genitals

or

pubic

area.

b.

Any

person

engaging

in

a

sex

act,

as

defined

in

section

9

702.17.

c.

The

covered

genitals

of

a

male

person

that

are

in

a

11

discernibly

turgid

state.

This

bill

relates

to

indecent

exposure,

including

the

unlawful

electronic

transmission

of

sexually

explicit

visual

material.

The

bill

provides

that

a

person

who

is

18

years

of

age

or

19

older

commits

a

serious

misdemeanor

if

the

person

knowingly

20

sends

a

picture

or

video,

which

the

person

knows

or

reasonably

21

should

know

is

unsolicited

and

unwanted

by

the

recipient,

by

22

electronic

means

depicting

any

of

the

following:

any

person’s

23

genitals

or

pubic

area;

any

person

engaging

in

a

sex

act,

as

24

defined

in

Code

section

702.17;

or

the

covered

genitals

of

a

25

male

person

that

are

in

a

discernibly

turgid

state.

A

serious

26

misdemeanor

is

punishable

by

confinement

for

no

more

than

one

27

year

and

a

fine

of

at

least

$430

but

not

more

than

$2,560.
