VENTILATOR-DEPENDENT

RECIPIENTS

SERVICES

UNDER

MEDICAL

ASSISTANCE

PROGRAM.

The

department

of

health

and

2

human

services

shall

adopt

rules

pursuant

to

chapter

17A

for

3

purposes

of

the

medical

assistance

program

that

do

all

of

the

4

following:

5

1.

Require

ventilator

services

to

be

provided

to

a

6

ventilator-dependent

recipient

based

on

need

and

not

on

the

7

recipient’s

age.

8

2.

Permit

any

qualified

provider

to

provide

services

to

a

9

ventilator-dependent

recipient.

EXPLANATION

The

inclusion

of

this

explanation

does

not

constitute

agreement

with

12

the

explanation’s

substance

by

the

members

of

the

general

assembly.

This

bill

requires

the

department

of

health

and

human

14

services

to

adopt

rules

related

to

ventilator-dependent

15

recipients

for

purposes

of

the

medical

assistance

program

16

(Medicaid).

The

rules

shall

require

ventilator

services

to

17

be

provided

to

a

ventilator-dependent

recipient

based

on

the

18

recipient’s

need

and

not

on

the

recipient’s

age.

The

rules

19

shall

also

permit

any

qualified

provider

to

provide

services

to

20

a

ventilator-dependent

recipient

enrolled

in

Medicaid.
