structure

regulated

For

administrative

efficiency,

the

department

shall

provide

a

single

application

DATE.

This

Act,

being

deemed

of

immediate

importance,

takes

effect

upon

enactment.

CONTINUED

APPLICABILITY

OF

REGULATORY

PRACTICE.

Notwithstanding

the

provisions

of

this

Act,

on

and

after

the

effective

date

of

this

Act

the

department

of

7

natural

resources

shall

regulate

activities

related

to

the

8

construction,

expansion,

and

operation

of

anaerobic

digester

9

systems,

including

the

storage

and

use

of

materials

including

10

manure

and

digester

feedstock

in

the

digestion

process,

the

11

processing

of

digestates,

and

the

storage

and

application

of

12

digestates,

in

substantially

the

same

manner

as

the

department

13

regulated

those

activities

on

March

1,

2025.

14

2.

This

section

is

repealed

on

the

publication

date

of

15

the

edition

of

the

Iowa

administrative

bulletin

that

includes

16

a

statement

by

the

director

of

the

department

of

natural

17

resources

that

all

rules

required

to

effectively

administer

18

and

enforce

the

provisions

of

this

Act

have

been

adopted.

The

19

department

shall

forward

a

copy

of

the

statement

to

the

Iowa

20

Code

editor

prior

to

its

publication

in

the

Iowa

administrative

bulletin.
