1.

Section

34A.7A,

subsection

1,

paragraph

a,

Code

2026,

is

amended

to

read

as

follows:

a.

(1)

The

director

shall

adopt

by

rule

a

monthly

3

surcharge

of

one

dollar

and

fifteen

cents,

subject

to

4

adjustment

pursuant

to

subparagraph

(2),

to

be

imposed

on

5

each

originating

service

number

provided

in

this

state.

The

6

surcharge

shall

be

imposed

uniformly

on

a

statewide

basis

7

and

simultaneously

on

all

originating

service

numbers

as

8

provided

by

rule

of

the

director.

The

surcharge

shall

not

be

9

imposed

on

wire-line-based

communications

or

prepaid

wireless

10

telecommunications

service.

Each

year

beginning

July

1,

2027,

the

director

shall

12

adopt

by

rule

a

two

percent

increase

to

the

monthly

surcharge,

13

rounded

to

the

next

highest

full

cent,

to

be

effective

July

1

of

each

calendar

year.

The

newly

increased

monthly

surcharge

15

amount

shall

be

imposed

uniformly

on

a

statewide

basis

and

16

simultaneously

on

all

originating

service

numbers

as

provided

by

rule

of

the

director.

repealed.

This

bill

relates

to

emergency

telephone

systems,

including

5

the

amount

and

allocation

of

the

emergency

communication

6

service

surcharge

and

reimbursement

requirements

of

joint

911

7

service

boards.

Under

current

law,

a

$1.00

monthly

surcharge

is

imposed

9

on

each

originating

service

number

provided

in

this

state

10

for

emergency

communication

services.

The

bill

increases

11

the

surcharge

to

$1.15.

Additionally,

the

bill

requires

the

12

director

of

the

department

of

homeland

security

and

emergency

13

management

to

annually

increase

the

monthly

surcharge

by

2

14

percent,

beginning

on

July

1,

2027.

The

annual

increase

will

15

be

uniform

across

the

state

and

will

occur

simultaneously

for

16

all

numbers.

Under

current

law,

the

911

program

manager

allocates

to

18

the

joint

service

boards

60

percent

of

the

total

amount

of

19

surcharge

generated

per

calendar

quarter.

The

bill

decreases

20

this

percentage

allocated

to

55

percent

through

June

30,

21

2028,

or

upon

completion

of

phase

1

and

phase

2

of

the

next

22

generation

911

transition,

whichever

occurs

first.

On

July

1,

23

2028,

or

once

phase

1

and

phase

2

of

the

next

generation

911

24

transition

are

completed,

the

allocation

reverts

back

to

60

25

percent.

Under

current

law,

the

911

program

manager

may

request

27

reimbursement

from

each

joint

911

service

board

for

certain

28

reasonable

costs

related

to

the

delivery

of

911

call

traffic

to

29

public

safety

answering

points,

which

must

be

reimbursed

within

30

30

days

of

the

request.

The

bill

repeals

this

provision.
