Section
321.234A,
subsection
3,
Code
2026,
is

amended
to
read
as
follows:

provided

an
all-terrain
vehicle
is

a
motor
vehicle
for
purposes
of
this
chapter
.
Therefore,
an

all-terrain
vehicle
operated
on
a
highway
shall
be
equipped
5
with
the
parts,
lamps,
and
other
equipment
in
proper
condition
6
and
adjustment
as
required
under
this
chapter
for
motor
7
vehicles,
including
but
not
limited
to
the
parts,
lamps,
and
8
equipment
required
under
sections
321.383,
321.386
,
321.387
,
9
321.404
,
321.432
,
and
321.437
.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
12
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Under
current
law,
an
all-terrain
vehicle
(ATV)
operated
on
14
a
highway
must
be
equipped
with
the
parts,
lamps,
and
other
15
equipment
in
proper
condition
and
adjustment
as
required
for
16
motor
vehicles.
In
addition,
a
person
operating
an
ATV
on
17
a
highway
is
prohibited
from
operating
the
ATV
at
speeds
in
18
excess
of
35
miles
per
hour
(MPH).
Pursuant
to
Code
section
19
321.383,
when
operated
on
a
highway
at
a
speed
of
35
MPH
20
or
less,
any
vehicle
principally
designed
for
use
off
the
21
highway
is
required
to
be
identified
with
a
reflective
device
22
in
accordance
with
the
standards
of
the
American
society
of
23
agricultural
engineers.

This
bill
specifies
that
the
existing
requirements
under
25
Code
section
321.383
apply
to
ATVs
when
operated
on
a
highway.
26
A
person
who
operates
a
vehicle
on
a
highway
without
27
displaying
a
required
slow-moving
vehicle
reflective
device
28
commits
a
simple
misdemeanor
punishable
by
a
$45
scheduled
29
fine.
