shall

all

the

department

of

health

and

human

services

in

the

administration

of

the

Iowa

youth

survey

described

in

section

135.11,

subsection

Report

the

results

of

the

administration

of

the

Iowa

youth

survey

to

the

department

of

education

and

the

department

of

health

and

human

services.

The

report

shall

not

contain

any

26

personally

identifiable

information

related

to

any

student.

Sec.

REPEAL.

Section

279.79,

Code

2025,

is

repealed.

administered

to

or

requires

school

districts,

accredited

nonpublic

schools,

charter

schools,

and

innovation

zone

schools

to

the

department

of

health

and

human

services

in

the

administration

of

the

Iowa

youth

survey,

which

is

administered

2

every

two

years

to

students

enrolled

in

grades

6,

8,

and

11,

3

and

contains

questions

related

to

student

health

behaviors

and

4

experiences.

Schools

are

required

to

report

the

results

of

5

the

Iowa

youth

survey

to

the

department

of

education

and

the

6

department

of

health

and

human

services.

Current

Code

section

279.79

provides

that

school

districts

8

must

receive

the

prior

written

consent

of

a

student’s

parent

or

9

guardian

before

requiring

a

student

to

take

part

in

any

survey,

10

analysis,

activity,

or

evaluation

that

reveals

information

11

concerning

certain

specified

subjects.

Current

Code

section

12

279.79

also

prohibits

an

employee

of

a

school

district,

or

a

13

contractor

engaged

by

a

school

district,

from

answering

any

14

question

pertaining

to

any

particular

student

enrolled

in

15

the

school

district

in

any

survey

related

to

the

social

or

16

emotional

abilities,

competencies,

or

characteristics

of

the

17

student,

unless

the

board

of

directors

of

the

school

district

18

satisfies

certain

specified

requirements.

Charter

schools

19

and

innovation

zone

schools

are

required

to

comply

with

the

20

provisions

of

Code

section

279.79.

The

bill

repeals

Code

21

section

279.79

and

strikes

provisions

requiring

charter

schools

22

and

innovation

zone

schools

to

comply

with

the

provisions

of

23

Code

section

279.79.
