1.

NEW

SECTION

.

191.9A

Food

products

containing

1

a

vaccine.

2

1.

As

used

in

this

section,

“vaccine

or

vaccine

material”

3

means

a

substance

intended

for

use

in

humans

to

stimulate

4

the

production

of

antibodies

and

provide

immunity

against

5

disease,

if

prepared

from

the

causative

agent

of

a

disease,

its

6

products,

or

a

synthetic

substitute,

and

treated

to

act

as

an

7

antigen

without

inducing

the

disease.

2.

A

person

shall

not

directly

or

indirectly

offer

for

sale

9

or

sell

food

processed

for

human

consumption

if

all

of

the

10

following

apply:

11

a.

The

food’s

ingredients

include

a

vaccine

or

vaccine

12

material

that

has

been

approved

by

the

United

States

food

and

13

drug

administration.

b.

The

food’s

packaging

or

wrapping

is

not

attached

with

15

a

conspicuous

label

that

notifies

persons

the

food

contains

a

16

vaccine

or

vaccine

material.

EXPLANATION

The

inclusion

of

this

explanation

does

not

constitute

agreement

with

the

explanation’s

substance

by

the

members

of

the

general

assembly.

This

bill

amends

Code

chapter

191

requiring

food

offered

or

21

exposed

for

sale,

or

sold,

in

package

or

wrapped

form,

to

be

22

labeled

(Code

section

191.1).

The

Code

chapter

is

administered

23

by

the

department

of

agriculture

and

land

stewardship

(DALS).

24

The

bill

applies

to

processed

food,

if

the

food’s

ingredients

25

include

a

vaccine

or

vaccine

material

approved

by

the

United

26

States

food

and

drug

administration.

The

food’s

package

or

27

container

must

be

attached

with

a

label

notifying

persons

of

28

that

ingredient.

DALS

is

authorized

to

petition

a

district

29

court

for

injunctive

relief

to

prevent

a

violation

(Code

30

section

191.10).

A

person

who

violates

the

bill

is

guilty

of

a

31

simple

misdemeanor

(Code

section

189.21).

A

simple

misdemeanor

32

is

punishable

by

confinement

for

no

more

than

30

days

and

a

33

fine

of

at

least

$105

but

not

more

than

$855.
