1.

NEW

SECTION

8A.316A

Fire

fighting

foam

——

contract.

The

department

shall

establish

a

master

contract

pursuant

3

to

section

8A.311A

for

the

purchase

of

fire

fighting

foam

4

from

a

seller

whose

product

contains

the

greatest

content

of

5

soybean-based

materials

without

containing

perfluoroalkyl

or

6

polyfluoroalkyl

substances

or

fluorine

components.

Sec.

2.

LOCAL

GOVERNMENT

PURCHASES.

A

local

government

8

entity

with

authority

over

a

fire

department

shall

pass

an

9

ordinance

by

January

1,

2027,

determining

whether

the

entity

10

will

purchase

soybean-based

fire

fighting

foam.

EXPLANATION

inclusion

this

the

general

This

bill

requires

the

department

of

administrative

services

15

(DAS)

to

establish

a

master

contract

for

the

purchase

of

16

fire

fighting

foam

from

a

seller

whose

product

contains

the

17

greatest

content

of

soybean-based

materials

without

containing

18

perfluoroalkyl

or

polyfluoroalkyl

substances

or

fluorine

19

components.

Under

current

law,

DAS

must

establish

master

20

contracts

on

a

competitive

basis,

and

the

purchase

of

a

good

21

or

service

pursuant

to

a

master

contract

is

deemed

to

satisfy

22

competitive

bidding

requirements.

Upon

the

establishment

of

23

a

master

contract

for

a

good

or

service,

a

state

agency

must

24

purchase

the

good

or

service

pursuant

to

the

master

contract,

25

unless

an

exception

applies.

Governmental

subdivisions

may

26

purchase

a

good

or

service

pursuant

to

a

DAS

master

contract.

The

bill

also

requires

local

governments

with

authority

over

28

a

fire

department

to

pass

an

ordinance

by

January

1,

2027,

29

determining

whether

the

entity

will

purchase

soybean-based

fire

30

fighting

foam.
