Code

read

as

follows:

Family

interactions

shall

continue

regardless

of

a

parent’s

failure

to

comply

with

the

requirements

of

a

court

order

or

the

department

,

provided

there

is

no

finding

by

5

a

court

or

the

department

that

such

interaction

would

be

6

detrimental

to

the

child

unless

a

court

finds

that

substantial

7

evidence

exists

that

the

family

interactions,

whether

8

supervised

or

unsupervised,

would

pose

a

serious

risk

of

9

physical

or

emotional

harm

to

the

child

.

interactions

during

an

ongoing

CINA

proceeding

must

continue

unless

a

court

or

the

department

of

health

and

human

services

finds

that

the

interactions

would

be

detrimental

to

a

child.

The

bill

requires

interactions

to

continue

unless

a

court

finds

substantial

evidence

exists

that

the

interactions,

whether

supervised

or

unsupervised,

would

22

pose

a

serious

risk

of

physical

or

emotional

harm

to

the

child.
