amended

to

read

as

follows:

person

who

knowingly

views,

photographs,

or

films

another

person,

for

the

purpose

of

arousing

or

gratifying

the

sexual

desire

of

any

person,

or

who

possesses

such

photograph

or

film,

commits

invasion

of

privacy

if

all

of

the

following

apply:

EXPLANATION

The

inclusion

of

this

explanation

does

not

constitute

agreement

with

the

explanation’s

substance

by

the

members

of

the

general

assembly.

Under

current

law,

to

be

guilty

of

invasion

of

privacy,

a

10

person

must

knowingly

view,

photograph,

or

film

another

person

11

for

the

purpose

of

arousing

or

gratifying

the

sexual

desire

of

12

any

person,

if

the

other

person

does

not

consent

or

is

unable

13

to

consent

to

being

viewed,

photographed,

or

filmed;

the

other

14

person

is

in

a

state

of

full

or

partial

nudity;

and

the

other

15

person

has

a

reasonable

expectation

of

privacy

while

in

a

state

16

of

full

or

partial

nudity.

This

bill

adds

that

a

person

who

17

is

in

possession

of

such

a

photograph

or

film

is

guilty

of

18

invasion

of

privacy.

19

A

violation

of

Code

section

709.21

is

an

aggravated

20

misdemeanor

and

a

tier

II

sex

offense.

A

person

convicted

of

21

the

offense

is

required

to

register

as

a

sex

offender

for

a

22

period

of

10

years.
