1.

NEW

SECTION

.

136D.3A

Minors’

use

of

tanning

1

devices

prohibited.

2

A

tanning

facility

shall

not

allow

a

person

under

eighteen

3

years

of

age

to

use

a

tanning

device.

EXPLANATION

5

The

inclusion

of

this

explanation

does

not

constitute

agreement

with

6

the

explanation’s

substance

by

the

members

of

the

general

assembly.

This

bill

prohibits

a

tanning

facility

from

allowing

a

8

person

under

18

years

of

age

to

use

a

tanning

device.

9

By

operation

of

law,

a

person

who

violates

the

bill

10

is

subject

to

enforcement

actions

by

the

department

of

11

inspections,

appeals,

and

licensing,

including

a

civil

12

penalty

not

to

exceed

$1,000

and

an

injunction

restraining

any

13

violation.
