AN ACT concerning school districts; relating to boards of education;
requiring each board of education to allocate the amount of
membership association dues to individual board members; prohibiting
payment of such dues if a board member elects not to join such
membership association; authorizing payment of such dues if a board
member elects to join a membership organization; amending K.S.A.
72-1145 and repealing the existing section.
Be it enacted by the Legislature of the State of Kansas:
New Section 1. (a) In each fiscal year, the board of education of each
school district shall allocate in equal proportions the total amount of dues
that are proposed to be paid to any membership association using public
moneys to all members of such board. If a board member elects not to be a
member of a membership association, the amount of moneys allocated to
such board member for such purpose shall not be paid to such membership
association in such fiscal year and such board member shall not be a
member of such membership organization. If a board member elects to be
a member of a membership association, the amount of moneys allocated to
such board member for such purpose may be paid to such membership
association and such board member may be a member of such membership
organization.
(b) As used in this section, "membership association" means any not-
for-profit corporation, including any department or division of such
corporation, the majority of whose board membership is comprised of
members elected to the board of education of any school district.
Sec. 2. K.S.A. 72-1145 is hereby amended to read as follows: 72-
1145. Except as otherwise provided in section 1, and amendments thereto,
the board of education of any school district or the board of trustees of any
community junior college is hereby authorized to appropriate money
moneys out of its general fund to pay the annual dues in the Kansas
association of school boards.
Sec. 3. K.S.A. 72-1145 is hereby repealed.
Sec. 4. This act shall take effect and be in force from and after its
publication in the statute book.
