AN ACT concerning insurance; relating to health insurance plans;
establishing restrictions on the use of step therapy protocols for
prescription medication.
Be it enacted by the Legislature of the State of Kansas:
Section 1. (a) As used in this section:
(1) "Advanced, metastatic cancer" means cancer that has spread from
the primary or original site of the cancer or nearby tissues, lymph nodes or
other areas of the body.
(2) "Associated conditions" means the symptoms or side effects
associated with advanced, metastatic cancer or its treatment and which, in
the judgment of the healthcare practitioner, further jeopardizes the health
of a patient if left untreated.
(b) A health benefit plan that provides coverage for advanced,
metastatic cancer and associated conditions shall not require, before the
health benefit plan provides coverage of a prescription drug approved by
the United States food and drug administration, the enrollee to:
(1) Fail to successfully respond to a different drug; or
(2) have a history of failure with a different drug.
(c) This section shall only apply to a drug that is:
(1) Consistent with best practices for the treatment of advanced,
metastatic cancer or an associated condition;
(2) supported by peer-reviewed, evidence-based literature; and
(3) approved by the United States food and drug administration.
Sec. 2. This act shall take effect and be in force from and after its
publication in the statute book.
