AN ACT concerning real property of the state board of regents or a state
educational institution; authorizing the state board of regents to sell and
convey real property valued at $5,000,000 or less without further
legislative authorization; requiring the submission of an annual report
listing any such real property sales to the legislature.
Be it enacted by the Legislature of the State of Kansas:
Section 1. (a) Except as provided in K.S.A. 74-3254 and 76-7,152,
and amendments thereto, the state board of regents is hereby authorized to
sell and convey real property of the state board of regents or a state
educational institution that has a market value of $5,000,000 or less
without further legislative authorization, subject to the provisions of this
section.
(b) The state board of regents shall:
(1) Have the land appraised by three disinterested appraisers to
determine the market-value appraisal of such real property;
(2) adopt policies governing the procedures to implement this section;
and
(3) submit to the legislature at each regular session a report listing
any such real property sales that occurred during the previous fiscal year
pursuant to this section.
(c) All proceeds from the sale and conveyance of such real property
shall be remitted to the state treasurer in accordance with the provisions of
K.S.A. 75-4215, and amendments thereto. Upon receipt of each such
remittance, the state treasurer shall deposit the entire amount in the state
treasury to the credit of the appropriate special revenue fund of the state
board of regents or such state educational institution as designated by the
president or chancellor of such board or institution.
(d) Any sale and conveyance authorized pursuant to this section shall
not be subject to the provisions of K.S.A. 75-6609 or 75-6611, and
amendments thereto.
(e) As used in this section, "state educational institution" means the
same as defined in K.S.A. 76-711, and amendments thereto.
Sec. 2. This act shall take effect and be in force from and after its
publication in the statute book.
