AN ACT concerning health and healthcare; relating to day care facilities;
permitting certain healthcare providers to complete health assessments
for children enrolled at day care facilities; requiring such facilities to
keep such assessments on file.
Be it enacted by the Legislature of the State of Kansas:
Section 1. (a) (1) For each child under 10 years of age enrolled for
care at a day care facility and each child under 16 years of age who
resides in such day care facility, a completed medical record on the form
provided by the director of the Kansas office of early childhood shall be on
file at the day care facility. Such form shall include:
(A) The results of a health assessment conducted by a physician, a
physician assistant, an advanced practice registered nurse, a chiropractor
or a nurse approved to perform health assessments; and
(B) a medical history obtained from the parent or legal guardian.
(2) At least once every 12 months that an applicant with a temporary
permit or a licensee provides care for a child, such applicant or licensee
shall review with each child's parent or legal guardian the child's medical
history.
(b) As used in this section:
(1) "Advanced practice registered nurse" means an advanced practice
registered nurse issued a license pursuant to and who has authority to
prescribe drugs under K.S.A. 65-1130, and amendments thereto.
(2) "Chiropractor" means an individual licensed to practice
chiropractic in this state.
(3) "Day care facility" means the same as defined in K.S.A. 75-7708,
and amendments thereto.
(4) "Nurse" means an individual who is licensed to practice
professional nursing as defined by K.S.A. 65-1113, and amendments
thereto.
(5) "Physician" means an individual licensed by the state board of
healing arts to practice medicine and surgery.
(6) "Physician assistant" means an individual licensed in accordance
with K.S.A. 65-28a04, and amendments thereto, who provides patient
services under the direction and supervision of a supervising physician.

(c) This section shall be a part of and supplemental to article 77 of
chapter 75 of the Kansas Statutes Annotated, and amendments thereto.
Sec. 2. This act shall take effect and be in force from and after its
publication in the statute book.
