HOUSE BILL No. 2596
AN ACT concerning the secretary of corrections; relating to the prison-made goods act of
Kansas; permitting certain contracts for the production of manufactured or modular
homes for a pilot program at the Hutchinson correctional facility ; requiring that the
secretary charge average rates for rent and wages and require the private individual,
corporation, partnership or association to pay all costs related to the project for such
contracts; providing for a nationally recognized construction education certification
program for participants of such pilot program; providing for an annual report by the
secretary of corrections; amending K.S.A. 75-5275a and repealing the existing
section.
Be it enacted by the Legislature of the State of Kansas:
Section 1. K.S.A. 75-5275a is hereby amended to read as follows:
75-5275a. (a) Notwithstanding any provision of the prison-made goods
act of Kansas to the contrary Except as provided in subsection (b) , the
secretary shall not establish or maintain a home building program
which manufacturers that manufactures or produces housing units
which that would compete with the:
(1) (A) Manufactured homes or modular homes manufactured,
assembled or sold by manufactured home manufacturers; or
(B) manufactured homes or modular homes sold by manufactured
home dealers; or
(2) (A) modular homes manufactured, assembled or sold by
modular home manufacturers; or
(B) modular homes sold by modular home dealers.
(b) The provisions of subsection (a) shall not apply to:
(1) The vocational building program; or
(2) any contract authorized by K.S.A. 75-5275(c), and
amendments thereto, for a pilot program at the Hutchinson
correctional facility as provided in subsection (c).
(c) (1) The secretary may establish and maintain a pilot program
that manufactures or produces housing units at the Hutchinson
correctional facility. Any private individual, corporation, partnership
or association contracting with the secretary as a part of such pilot
program shall provide a nationally recognized construction education
certification program for participants and evaluate program success
after participation and release.
(2) Such pilot program shall expire on December 31, 2031. The
secretary or the secretary's designee shall make an oral presentation
before the house committee on commerce, labor and economic
development and the senate committee on commerce at mutually
agreed times during the 2030 regular legislative session and provide a
report to each such committee with respect to the pilot program and
such program's effectiveness.
(3) For any such contract, the secretary shall charge the regional
average commercial rate for rent for the square footage used for the
project and the regional average wage for labor, without allowance for
any lesser training wage, for the skill level or levels used for the
project.
(4) For any such contract, the secretary shall require that the
private individual, corporation, partnership or association pay all
costs associated with the project including, but not limited to, utilities,
project start-up costs, project training costs and project administrative
costs. For any such contract with a nonprofit organization, the
secretary shall also require that the nonprofit organization not request
a property tax exemption for such housing units and agree to pay
property or ad valorem taxes on such housing units if such housing
units are retained and owned by such nonprofit organization.
(5) During each regular session of the legislature, the secretary of
corrections shall submit a report to the committee on ways and means
of the senate and the committee on appropriations of the house of
representatives relating to any such contracts.
(d) As used in this section:
(1) "Manufactured home," has the meaning ascribed to such term
by "manufactured home dealer," "manufactured home manufacturer"
and "modular home" mean the same as defined in K.S.A. 58-4202, and
amendments thereto;

(2) "manufactured home dealer" has the meaning ascribed to such
term by K.S.A. 58-4202, and amendments thereto;
(3) "manufactured home manufacturer" has the meaning ascribed
to such term by K.S.A. 58-4202, and amendments thereto;
(4) "modular home" has the meaning ascribed to such term by
K.S.A. 58-4202, and amendments thereto; and
(5) "secretary" means the secretary of corrections.; and
(6)(3) "vocational building program" means the vocational
building program operated by the secretary to provide individual,
freestanding buildings, not to exceed 1,000 square feet in size, to state
agencies for use by such agencies.
(c) The provisions of this section shall not apply to a vocational
building program.
(d)(e) This section shall be a part of and supplemental to the
prison-made goods act of Kansas.
Sec. 2. K.S.A. 75-5275a is hereby repealed.
Sec. 3. This act shall take effect and be in force from and after its
publication in the Kansas register.
