AN ACT concerning the department of corrections; relating to peer
support programs; establishing the department of corrections peer
support fund for such programs; transferring funds from the state
general fund to the department of corrections peer support fund during
the fiscal year ending June 30, 2027.
Be it enacted by the Legislature of the State of Kansas:
Section 1. (a) (1) There is hereby established in the state treasury the
department of corrections peer support fund. The fund shall be
administered by the secretary of corrections. Expenditures from such fund
shall be used for the purposes described in subsection (b). All expenditures
shall be made in accordance with appropriation acts upon warrants of the
director of accounts and reports issued pursuant to vouchers approved by
the secretary of corrections, or the secretary's designee.
(2) (A) On July 1, 2026, or as soon thereafter as moneys are
available, the director of accounts and reports shall transfer $500,000 from
the state general fund to the department of corrections peer support fund.
(B) For the fiscal year ending June 30, 2028, and each fiscal year
thereafter, in accordance with the provisions of appropriation acts, moneys
may be transferred to the department of corrections peer support fund from
the state general fund or one or more special revenue funds in the state
treasury as specified by such appropriation acts.
(b) (1) The department of corrections peer support fund shall be used
exclusively by the department of corrections for the department's peer
support program for corrections officers and other department employees.
Other expenditures from the fund may include, but not be limited to,
training of peer support team members, program materials, equipment,
travel expenses, staffing costs associated with the peer support program
and other expenses as may be necessary for the effective implementation
and operation of the department of corrections peer support services.
(2) Peer support services funded by this section shall promote mental
health, wellness, crisis intervention and suicide prevention among
department of corrections employees in accordance with department
policies and recognized best practices.
(c) The secretary of corrections may adopt rules and regulations as

necessary to administer and implement the department of corrections peer
support fund.
(d) The department of corrections peer support fund shall be used for
the purposes set forth in this section and for no other governmental
purpose. It is the intent of the legislature that the fund shall remain intact
and inviolate for the purposes set forth in this section and moneys in the
fund shall not be subject to the provisions of K.S.A. 75-3722, 75-3725a or
75-3726a, and amendments thereto.
(e) On or before the 10 th day of each month commencing on July 1,
2026, the director of accounts and reports shall transfer from the state
general fund to the department of corrections peer support fund interest
earnings based on:
(1) The average daily balance of moneys in the department of
corrections peer support fund for the preceding month; and
(2) the net earnings rate of the pooled money investment portfolio for
the preceding month.
(f) The secretary of corrections shall submit a report to the governor
and the legislature on or before January 15 of each calendar year detailing
the expenditures from the department of corrections peer support fund
during the preceding calendar year and the effectiveness of the peer
support program.
Sec. 2. This act shall take effect and be in force from and after its
publication in the statute book.
