AN ACT concerning nondisclosure agreements; providing that a
nondisclosure agreement by any party in an action related to childhood
sexual abuse or human trafficking shall not be judicially enforceable in
a dispute involving childhood sexual abuse or human trafficking
allegations or claims.
Be it enacted by the Legislature of the State of Kansas:
Section 1. (a) Notwithstanding any other provision of law, a
nondisclosure agreement by any party in an action related to childhood
sexual abuse as defined in K.S.A. 60-523, and amendments thereto, or
human trafficking as defined in K.S.A. 21-5426, and amendments thereto,
shall not be judicially enforceable in a dispute involving childhood sexual
abuse or human trafficking allegations or claims , and shall be void as
contrary to the public policy of this state, except that identifying
information concerning a victim of childhood sexual abuse or human
trafficking shall be deemed and maintained as confidential.
(b) (1) Except as provided in paragraph (2), This section shall apply
to a nondisclosure agreement entered into before, on or after July 1, 2026.
(2) A person, including a party, may enforce or attempt to enforce a
nondisclosure agreement entered into before July 1, 2026, if the person
obtains a declaratory judgment that is final and not subject to appeal and
declares that the agreement or provision is enforceable.
(c) This section shall be known and may be cited as Trey's law.
Sec. 2. This act shall take effect and be in force from and after its
publication in the statute book.
