AN ACT concerning higher education; providing that an award of tenure
to a faculty member by any postsecondary educational institution shall
not create a right or property interest in continued employment with
such institution.
Be it enacted by the Legislature of the State of Kansas:
Section 1. (a) Notwithstanding any other provision of law, an award
of tenure to a faculty member by an institution shall not create a right or
property interest in continued employment with such institution.
(b) As used in this section:
(1) "Faculty member" means any unclassified employee of any
institution whose primary duties include teaching or research, regardless of
rank or title, except employees who are employed under an employment
contract;
(2) "institution" means any postsecondary educational institution as
defined in K.S.A. 74-3201b, and amendments thereto; and
(3) "tenure" means a feature of employment that is granted by an
institution in recognition of meritorious performance, which is conditioned
on future meritorious performance, and may confer special benefits,
processes or preferences.
(c) The provisions of this section shall apply to any award of tenure
to a faculty member by an institution prior to, on or after the effective date
of this act.
Sec. 2. This act shall take effect and be in force from and after its
publication in the Kansas register.
