AN ACT concerning education; relating to nonaccredited private
elementary and secondary schools; including a home school within the
definition of private elementary or secondary school; defining home
school; amending K.S.A. 72-4345 and repealing the existing section.
Be it enacted by the Legislature of the State of Kansas:
Section 1. K.S.A. 72-4345 is hereby amended to read as follows: 72-
4345. As used in this act:
(a) "Private elementary or secondary school" means an organization
which or home school that regularly offers education at the elementary or
secondary level and attendance at which satisfies the compulsory school
attendance laws of this state, but which is not accredited by the state board
of education.
(b) "Pupil records" means all records, files and data of pupils who are
or have been in attendance at a private elementary or secondary school.
(c) "Official custodian" means any officer or employee of a private
elementary or secondary school who is responsible for the custody and
maintenance of pupil records.
(d) "Home school" means a nonaccredited nonpublic school where a
parent or person acting as parent, as such terms are defined in K.S.A. 72-
3127, and amendments thereto, directs the private instruction of such
parent's or person's child.
Sec. 2. K.S.A. 72-4345 is hereby repealed.
Sec. 3. This act shall take effect and be in force from and after its
publication in the statute book.
