AN ACT concerning education; relating to postsecondary education
outcome programs; requiring the state board of regents to adopt rules
and regulations prohibiting state moneys from being allocated or
expended for certain low-earning outcome programs and submit an
annual report to the legislature; prohibiting political subdivisions from
allocating or expending public moneys for low-earning outcome
programs.
Be it enacted by the Legislature of the State of Kansas:
Section 1. (a) The state board of regents shall:
(1) Adopt rules and regulations prohibiting state moneys from being
allocated or expended, either directly or indirectly, for low-earning
outcome programs, as determined pursuant to section 84001 of public law
119-21. State moneys includes, but is not limited to, individual student
financial aid, base operational or instructional funding, separately or
specially appropriated aid or grants and capital or facilities funding;
(2) annually review the federal determination of low-earning outcome
programs pursuant to section 84001 of public law 119-21 and update the
rules and regulations adopted pursuant to paragraph (1), accordingly; and
(3) submit and make public an annual report to the legislature that
includes the programs prohibited from receiving state moneys,
enforcement of such prohibitions and the estimated fiscal impact of such
prohibitions.
(b) (1) No political subdivision shall allocate or expend local public
moneys, either directly or indirectly, for low-earning outcome programs as
determined in the rules and regulations adopted pursuant to subsection (a).
(2) As used in this subsection, "political subdivision" means political
or taxing subdivision of the state, including boards, commissions,
authorities, councils, committees, subcommittees and other subordinate
groups or administrative units thereof, receiving or expending and
supported in whole or in part by public moneys.
Sec. 2. This act shall take effect and be in force from and after its
publication in the statute book.
