AN ACT concerning children and minors; relating to recreational
facilities; requiring cardiac emergency response plans for such
facilities.
Be it enacted by the Legislature of the State of Kansas:
Section 1. (a) The governing body or chief executive officer of each
recreational youth facility shall adopt a comprehensive cardiac emergency
response plan, including policies and procedures for cardiac emergency
responses for each such facility operated by the governing body or chief
executive officer, based on the statewide standards developed by the
secretary of health and environment under K.S.A. 2025 Supp. 72-6288,
and amendments thereto. The governing body or chief executive officer
may utilize any materials, documentation, video recordings, training
modules and certifications published by organizations focused on
emergency cardiovascular care.
(b) The cardiac emergency response plan shall include, but is not
limited to, the following:
(1) Establishing of a cardiac emergency response team;
(2) identifying and implementing the placement of one or more
automated external defibrillators;
(3) identifying roles and responsibilities of facility personnel, local
law enforcement agencies and local emergency medical services in
implementing the cardiac emergency response plan;
(4) establishing procedures, including the roles and responsibilities of
facility personnel when responding to incidents involving an individual
experiencing a suspected sudden cardiac arrest while attending the facility,
including, but not limited to:
(A) Identifying and responding to individuals experiencing a
suspected sudden cardiac arrest;
(B) summoning emergency medical services;
(C) assisting emergency medical service providers; and
(D) documenting actions taken during such incident;
(5) conducting routine maintenance of automated external
defibrillators, including appropriate placement in accordance with the
statewide standards;
(6) designating facility personnel for training in the use of automated

external defibrillators and cardiopulmonary resuscitation during a cardiac
emergency;
(7) rehearsing cardiac emergency response plans, by simulation, by
all such designated personnel each year; and
(8) establishing communication systems with local emergency
medical services operating within close proximity to the facility.
(c) Each governing body or chief executive officer shall annually
review the cardiac emergency response plan and adopt any changes to
such plan as necessary.
(d) As used in this section, "recreational youth facility" means any
public or private facility, whether operated for profit or not for profit, that
regularly conducts organized recreational activities for individuals under
18 years of age and at which facility personnel is in attendance at all times,
including, but not limited to, swimming facilities, camps, gyms, play areas
and any facility that hosts before or after school care programs.
"Recreational youth facility" does not include any facility operated by a
school district that is subject to K.S.A. 2025 Supp. 72-6288, and
amendments thereto, or any day care facility as defined in K.S.A. 2025
Supp. 75-7708, and amendments thereto.
Sec. 2. This act shall take effect and be in force from and after its
publication in the statute book.
